A. 
The keeping or harboring of any animal or fowl, whether licensed or not, which by habitual howling, yelping, barking or other noise disturbs or annoys three or more families in a neighborhood, is unlawful and is hereby declared to be a public nuisance. Each day such nuisance exists shall constitute a separate offense, and the owner or custodian shall be subject to penalties as provided under § 23-3.
B. 
Trespass.

(1) 
It shall be unlawful to allow or permit any animal to trespass on private or public property so as to damage or destroy any property or thing of value, and such trespass is hereby declared to be a nuisance, and any such animal may be impounded by the Animal Control Officer.
(2) 
It shall be unlawful to allow any animal to be at large or leashed within the fenced area surrounding Carcieri Field. Notwithstanding any section of this chapter to the contrary, the fine for the first and any subsequent violations of this subsection shall be $100.
C. 
Whenever it shall be affirmed in writing and signed by a resident of the Town or by a person regularly employed in the neighborhood, and such complaint is verified by the Animal Control Officer, that an animal is a habitual nuisance by reason of trespassing, howling, barking or other noise, or damage to property, or in any other manner causing undue annoyance, the Animal Control Officer, if he/she finds the nuisance to exist, shall serve notice upon the owner or custodian of such animal that such nuisance must be abated within a period not to exceed three days after the service of such notice. Failure to comply with such notice shall constitute a violation of this chapter, and the owner or custodian shall be subject to penalties as provided under § 23-3.
No dogs are allowed in any commercial establishment within the Town during the time such commercial establishment is open to the public or in any eating place within the Town at any time. Guide, hearing and service dogs are excluded from this section.

It shall be unlawful to keep more than three dogs at the same residence. This provision shall not apply to licensed kennels or any litter of dogs less than three months of age.

No person shall carry on the business of keeping swine within the limits of the Town without a license therefor first granted by the Town Council.
B. 
All applications to keep swine as a business shall be referred to the State Department of Health, which shall report thereupon before such applications are granted by the Town Council.
C. 
All licenses to keep swine as a business shall be for the current year, shall terminate on the last day of December in each year, shall be issued by the Town Clerk under the direction of the Town Council, and shall contain the condition that they may be revoked at any time by the Town Council.
D. 
This section shall not apply to owners or lessees of land who are keeping swine for their own personal use.

All applications to keep swine for personal use shall be referred to the Chief of Police and State Department of Health, which shall report thereon before such applications are granted by the Town Council.

All licenses to keep swine for personal use shall be for the current year and shall terminate on the last day of December in each year, and shall be issued by the Town Clerk under the direction of the Town Council, and shall contain the condition that they may be revoked at any time by the Town Council. The price of the license shall be found in the license schedule in Chapter 93, Fees.
