Pursuant to the authority invested in the Madison Board of Selectmen by 29-A M.R.S.A. § 2395, the Madison Board of Selectmen hereby finds the following:
A.
During certain times of the year, the road base of certain roads is insufficient to sustain motor vehicle traffic whose weight, loaded or unloaded, exceeds 23,000 per square foot.
B.
It is in the public interest to limit traffic on Town ways during certain times of the year to protect those designated roads from damage caused by heavy vehicles.
A.
Therefore, the Madison Board of Selectmen hereby orders the seasonal closing of Town ways designated below to vehicles whose gross weight exceeds 23,000 pounds, loaded or unloaded, during such times as the Road Commissioner determines necessary to protect said ways from damage. Further, the Road Commissioner shall be responsible for placing conspicuous notice of this order at the beginning of said Town ways, notifying the public of the closing. Any violation of this article shall be a civil infraction subject to a fine of not less than $250 (29-A M.R.S.A. § 2395) nor more than $1,000. Each violation shall be deemed a separate offense. In addition to any fine, the municipal officers may seek legal action restitution for the cost of repairs to any damaged way or bridge and reasonable attorney fees and court costs.
