Pursuant to the provisions of paragraph (c) of Section 4 of the Sewerage Authorities Law of the State of New Jersey (Laws of 1946, Chapter 138, as amended and supplemented),[1] there is hereby created a public body corporate and politic under the name and style of the "Rockaway Valley Regional Sewerage Authority."

The Rockaway Valley Regional Sewerage Authority is and shall be an agency and instrumentality of the participants created by parallel ordinances duly adopted by their governing bodies and is a sewerage authority as contemplated and provided for by said Sewerage Authority Law[1] and shall have and exercise all of the powers and perform all of the duties provided for by said Sewerage Authorities Law and any other statutes heretofore or hereafter enacted and applicable thereto.

The Rockaway Valley Regional Sewerage Authority shall consist of nine members thereof, and one of such members shall be appointed by the governing body of the City of Jersey City, all in accordance with the provisions of paragraphs (c) and (1) of said Sewerage Authorities Law.[1]

A copy of this Article, duly certified by the Town Clerk, shall forthwith be filed by said Town Clerk in the office of the Secretary of State of the State of New Jersey.

There is hereby adopted by the Town of Dover, County of Morris, "The Local Sewer Service Rules Governing the Use of the Rockaway Valley Regional Sewerage Authority Treatment System, February 1982," for the purpose of establishing rules and regulations affecting the installation, maintenance, repair and control of plumbing and drainage of buildings and the connection thereof with the sanitary sewer system owned and maintained by the Town of Dover and the Rockaway Valley Regional Sewerage Authority. Pursuant to the provisions of N.J.S.A. 40:49-5.1, a copy of said rules is annexed to this Article,[1] and three copies of the same have been and are now filed in the office of the Clerk of the Town of Dover and will remain on file there for the use and examination of the public. Wherever the word "municipality" appears in the text of the Local Sewer Service Rules, it shall be understood to mean the Town of Dover.

Any person who shall violate any provisions of the Local Sewer Service Rules herein adopted or shall fail to comply with any of these requirements thereof shall, upon conviction, be punished by a fine not exceeding $1,000, by imprisonment in the county jail for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof. Each violation of said rules and each and every day the same is violated shall be deemed to be a separate and distinct offense. Said fine and penalty shall be in addition to and not in lieu of any other remedy or penalty provided by law.
