[HISTORY: Adopted by the Mayor and Board of Aldermen of the Town of Dover 7-27-1970 as Art. 36 of the 1969 Revised Ordinances. Amendments noted where applicable.]

As used in this chapter, the following terms shall have the meanings indicated:
ATHLETIC CLUB
Any person or group of persons, association or corporation, which meets for the purpose of promoting athletic sports, contests, exhibitions, classes or gymnasium.
SOCIAL CLUB
Any person or group of persons, association or corporation, which owns, leases, operates or controls premises for the purpose of social intercourse and entertainment (excluding, however, fraternal organizations of state or national scope and religious organizations).
It shall not be lawful for any person or persons, association or corporation to operate, lease or control or promote any social, athletic or gymnastic organization, group or club or to give athletic, boxing or gymnastic exhibitions without having first obtained a license from the Town Clerk so to do.

The Town Clerk is hereby authorized to issue any such license, upon approval by the Mayor and Board of Aldermen, upon payment by the applicant of the fee of $25.
Every such license shall remain in force and be valid up to December 31 of each year and can be suspended or revoked in the discretion of the Mayor and Board of Aldermen and shall apply only to the person or persons, association or corporation to whom granted and shall not be transferable. The violation of any town, county, state or national ordinance or statute, or the operation of the premises in a disorderly, boisterous or objectionable manner, or the congregation upon the premises of undesirable people, shall constitute sufficient cause for the suspension or revocation of said license.

Any social and athletic club licensed under this chapter shall not operate said facility after the hour of 2:00 a.m., without specific approval from the Mayor and Board of Aldermen of the Town of Dover.
Any person or persons violating this chapter or conducting any premises as a social or athletic club, as herein defined, without a license, or after the license shall have been suspended or revoked, shall be subject to one or more of the following: forfeit and pay a fine of not more than one thousand ($1,000.) for each and every offense, be subject to a term of imprisonment not exceeding 90 days or be subject to a period of community service not exceeding 90 days.
