As used in this chapter, all of the definitions contained in § 160-5 of this Code are hereby incorporated by reference. In addition, the following terms shall have the meanings indicated:
- ACCESS ROAD
- A paved area used by motor vehicles for access to off-street parking for businesses, stores or rental apartments.
- PARKING AREAS
- Those areas provided for parking of motor vehicles as a convenience for stores, businesses or tenants of rental apartments.
- PRIVATE STREETS
- Includes only those streets, roads or highways dedicated to but not accepted by the Township, those intended to be dedicated to the Township and those not intended to be dedicated to the Township but open for public use.
- Paved walkways used by the public as a means of travel by pedestrians from a parking area to a store, business or apartment or from an apartment to a service area, such as a laundry or storage area, located in the same building or an adjacent building.
The owner or owners of private streets, access roads, parking areas and sidewalks in Evesham Township are hereby required to remove all snow and ice from the paved portions of said streets, access roads, parking areas and sidewalks within 12 hours of daylight after the same shall fall or be formed thereon, provided that the snowfall is in excess of two inches, as measured on the municipal parking lot, or that sufficient ice or slippery conditions have developed so as to create driving and walking hazards.
The Township Manager may bring an action to enforce the requirements of § 133-11 in the Evesham Township Municipal Court; or, whenever the Township Manager shall find that an emergency exists which requires immediate action to alleviate the aforementioned hazardous conditions, he may, without notice or hearing, issue an order to any owner, firm, person or corporation to correct such hazardous conditions. Such order shall be effective immediately and shall be fully complied with immediately.
The personal representative(s) or agent(s) of the owner or owners acting in any capacity, either for himself or the owner, under either personal appointment or pursuant to law, shall be held personally liable for any violation of this article.
