A.
Whenever the Chief of Police of the Borough of Fair Lawn
shall determine that a business in the Borough of Fair Lawn remaining open
after 11:00 p.m. is creating and will continue to create problems that relate
to the health, safety and welfare of the citizens of Fair Lawn, then and in
that event, the Chief of Police, after careful investigation, shall make a
finding in writing that a security problem exists and the Chief shall be authorized
to request the business remaining open to provide security assistance.
B.
The scope, nature and extent of such security shall be
determined by the Chief of Police after the aforementioned investigation and
which shall be in writing directed to the business operator in question.
All ordinances or parts or ordinances inconsistent with the terms of
this ordinance are hereby expressly repealed as to said inconsistencies except
that all state laws applying to certain designated business shall control
with respect to the subject matter in question of such state legislation.
