No person shall hereafter open, construct, pave, improve or, in any manner, do any work on a public street or right-of-way, whether dedicated, approved, accepted or otherwise, in the Borough without having first obtained a permit from the Borough Council to be issued by the Clerk/Municipal Administrator.
The application for a permit required under § 166-9 shall be submitted in duplicate to the Borough Clerk/Municipal Administrator, and the application shall request the issuance of a permit for the opening, construction, reconstruction, paving, repaving or improvement, for the work to be done on any portion of said public street or right-of-way in the Borough.
No permit shall be issued for the street improvement, as set forth in §§ 166-9 and 166-10, until such person has submitted to the Borough Council a plan or plans drawn by a licensed professional engineer showing existing grades or contours and proposed grades of streets, proposed typical cross sections of streets, right-of-way widths, a full and complete description of the drainage scheme, including profiles and piping if necessary, and description of all materials to be used in the construction and the proposed method of construction of the drainage scheme and of the public street or public right-of-way.
A. 
The plans as set forth in this section shall be submitted to the Borough Engineer for review and approval before any permit shall be issued by the Borough Council. The Borough Engineer shall have the right to recommend to the Borough Council that any of the requirements within this section may be waived where the Engineer gives the Borough a written opinion that such waiver will not impair the street plan of the Borough or future of street development within the Borough and that the granting of such waiver is not against the public interest. The Borough Council shall have the sole discretion to determine whether such a waiver shall be granted and to what extent, once a recommendation of waiver is received from the Borough Engineer.
B. 
No permit will be issued by the Borough Council until a satisfactory performance bond with sufficient sureties, or in the amount of 100% of the Borough Engineer's estimate of cost, is posted with the Borough, approved as to form and sureties by the Solicitor, or a cash deposit equivalent. All bonds shall guarantee completion in three years.
C. 
The Borough reserves the right to set the time limits for the proposed construction, reconstruction, paving, repaving or improving of any public street or public right-of-way within the Borough limits.
D. 
The clearing of the proposed street or public right-of-way shall conform to the New Jersey State Highway Department Standard Specifications for Road and Bridge Construction, 1989, or as amended, Article 2.1.1, 2.1.3, entitled "Clearing Site." All grading will be done to the full right-of-way width on the proposed street or public right-of-way.
E. 
All proposed streets or public rights-of-way shall have gutters six inches thick and 18 inches wide of class B concrete (State Highway Specifications) and shall be constructed in accordance with the New Jersey State Highway Department Standard Specifications for Road and Bridge Construction, 1961, or as amended, Article 5.4.1, 5.4.2, 5.4.3 entitled "Gutter."
F. 
All proposed streets or public rights-of-way shall have curbs six by eight by 18 inches of class B concrete (State Highway Specifications) and shall be constructed to conform to the New Jersey State Highway Department Standard Specifications for Road and Bridge Construction, 1961, or as amended, Article 5.5.1, 5.5.2, 5.5.3 entitled "Curbs and Headers."
G. 
Streets shall have sidewalks four inches thick and four feet wide and shall be constructed of Class C concrete (State Highway Specifications).
All applicants for a permit shall have the right, where the sidewalks on the streets are to be improved and opened in compliance with the above standards, to delay the installation of sidewalks for a period not to exceed the term of the bond, in those parts of the subdivision where residential construction is to occur, until such time as the lots in question are sold or until construction is commenced by the subdivider of the house or other structure to be built on the premises or until such time as the developer, in the case of a multifamily construction, is ready to commence the construction of the complex.
No proposed street or public right-of-way constructed, reconstructed, paved, repaved or improved shall have a grade of less than 0.4 of 1%.
No proposed street or public right-of-way shall be constructed, reconstructed, paved, repaved, repaired or improved as to carry water for more than 1,500 feet on the surface, and the water shall not be brought back to the surface until it reaches its disposal area.
The requirements as hereinabove set forth within this article shall apply to all dedicated rights-of-way, whether opened or unopened, which are not improved to the standards set forth herein and which will be required to handle the traffic flow from or to the subdivision and which have or have not been subject to prior acceptance by the Borough as public streets, with the exception of those streets designated as private lanes and qualifying as private lanes within Chapter 170, Subdivision and Land Development.
A certification from the applicant that all public utilities have been installed prior to beginning construction of the street's surface shall be presented to the Borough Council.
The applicant shall post with the Borough Clerk/Municipal Administrator a special escrow account an amount equal to 5% of the Borough Engineer's estimate of cost, which amount shall be used to cover all inspection fees and related costs of the Borough Engineer and all other Borough officials for services rendered relating to the applicant's application.

A. 
Before the issuance of a permit to excavate or open a street, an applicant shall submit to the Borough Clerk/Municipal Administrator a nonreturnable single fee in accordance with the following rate schedule:
(1) 
For openings less than 50 square feet, submit one check covering an application fee of $25 and an inspection fee of $115, totaling $140.
(2) 
For openings greater than 50 square feet, submit one check in the amount of $50 to cover the application fee. Inspection fees for such openings shall be estimated by the Borough Engineer based upon review of the application and the estimated field inspection expenses. The applicant shall then be notified of inspection fees.
B. 
Permits for openings on roadways under two-year road opening moratorium shall require review and approval by the Folsom Borough Road Supervisor. In no case shall the open cut method be used for utility crossings, unless authorized by the Road Supervisor and the Engineer. Emergency openings shall not require review and approval by the Road Supervisor.[2]

C. 
Any contractor desiring to open an existing roadway shall conform to the following specifications:
(1) 
Saw cut trench area using a circular saw.
(2) 
Excavate all unsuitable material and backfill with soil aggregate in layers not exceeding 12 inches loose measurement.
(3) 
Place bituminous stabilized base course, Mix I-2, to a compacted thickness of four inches.
(4) 
Place bituminous concrete surface course, Mix I-5, to a compacted thickness of two inches, matching existing grades.
(5) 
Seal coat the surface of the saw cut edge using RC-70 tack coat.
(6) 
Contractor shall pull straight edge longitudinally across opening to assure proper grade for acceptance by the Engineer.
(7) 
Contractor shall not perform road restoration process without notifying Borough Engineer 24 hours in advance of such work.
