Existing uses of buildings or land and existing buildings, including structures, which do not comply with one or more of the use requirements or of the area and bulk requirements of the district in which they are located shall be considered nonconforming. They shall be allowed to continue, provided they are otherwise lawful, and provided that the following requirements are observed:
A. 
Nonconforming buildings shall not be enlarged except in conformity with the requirements of the zoning district in which they are located.
B. 
Nonconforming uses shall not be enlarged so as to occupy a greater building or land area than was occupied on the date when such use became nonconforming.
C. 
Nonconforming uses or buildings which are or have been abandoned shall lose nonconforming status and must comply with all the requirements of the zoning district in which they are located.
D. 
A nonconforming building, the superstructure of which has been destroyed or removed, shall not be reconstructed except in conformity with the requirements of the zoning district in which it is located.

Notwithstanding the use restrictions contained in this chapter, any commercial use existing on January 14, 1981, that is currently nonconforming or any commercial use which was constructed based upon an approval granted pursuant to the Pinelands Comprehensive Management Plan that is currently nonconforming, other than intensive recreational facilities and those uses which are expressly limited in Article VII, may be expanded or altered, provided that:
A. 
The use was not abandoned or terminated subsequent to January 14, 1981;
B. 
The expansion or alteration of the use is in accordance with all of the minimum standards of Article VII of this chapter; and
C. 
The area of expansion does not exceed 50% of the floor area, the area of the use or the capacity of the use, whichever is applicable, on January 14, 1981, or which was approved pursuant to N.J.A.C. 7:50-4, Part V.
