[HISTORY: Derived from Ch. III, Sec. 3-14, of the Revised General Ordinances of the Borough of Fort Lee, adopted 3-1-1979. Amendments noted where applicable.]
A. 
The Mayor and Council of the borough have found that the books and other articles regularly loaned to the public by the Fort Lee Free Public Library have increased substantially in number, kind and value over the past years; and the number of books and other articles which are not returned by borrowers has also increased substantially.
B. 
The Mayor and Council of the borough has determined that it is in the best interests of the operation and efficiency of the library and the enforcement of library regulations to provide the library with the legal remedies afforded by the Municipal Court of the borough.
A. 
No person shall detain or fail to return a book or other article borrowed from the library after the date upon which it is due to be returned.
B. 
No person shall fail to pay any fine imposed by the library in violation of the rules and regulations established by the library.
The Director of the library be and is hereby empowered and authorized to file a complaint against any patron of the library who fails to return a book or other article which was borrowed from the library.
No such complaint shall be filed unless:
A. 
The library has caused to be sent by regular mail to the borrower or the borrower's parents, if the borrower is a minor, a letter informing the borrower that the article or articles are overdue and further informing the borrower of the provisions and sanctions of this chapter; and
B. 
Thirty days have elapsed from the date the letter was mailed and during such period of time the library has not received either the book or other article which is overdue or the replacement value of the book or other article.
In the event that a borrower has lost the book or other article which is overdue, the borrower shall only be liable for the replacement value of the book or other article.
Any person violating any provision of this chapter shall, upon conviction thereof, pay a fine of not less than the replacement value of the book or other article not returned to the library, plus an amount up to $150, plus court costs.
