All traffic and parking rules and regulations must be adhered to at all times.
It shall be unlawful to cause or permit the accumulation of dirt or debris on a public street, sidewalk, thoroughfare or right-of-way.
It shall be unlawful to cause or permit the existence of any condition which creates a hazard or danger to any lawful pedestrian, motor vehicle operator or member of the general public.
It shall be unlawful to abuse, damage or destroy any portion of the public sidewalk, road or property.
It is the intention of this article to permit any appropriate municipal agency, including the Building Department and Police Department, to supervise construction sites within the borough to ensure compliance with this article.
In order to safeguard the public against damage to public property in and about construction sites within the borough, no construction shall be permitted within the borough until such time as the person or persons responsible for such construction post the sum of $5,000 cash in an escrow account of the borough to protect against damage to public property.
The escrow account may be drawn upon by the borough to remedy or reimburse the borough for any damage resulting from a violation of this article.
The Construction Official of the borough has the discretion, based on the size and location of the construction site, to reduce or waive the amount of the escrow fund.
Where construction or demolition is to take place within the borough so close to adjoining property owners as to pose a real threat or harm to such adjoining property, whether such adjoining property be privately or publicly owned, the person or persons responsible for such construction or demolition shall post the sum of $10,000 cash in an escrow account with the borough to protect and reimburse such adjoining property owner in the event damage to said property does occur. The Construction Official of the borough has the discretion, based on the size and location of the construction site, to reduce or waive the amount of the escrow fund.
Upon the completion of all construction and demolition, any funds remaining in escrow, not utilized for the purposes expressed herein, shall be forthwith returned.
In addition to the remedies and rights granted to the borough herein, violations of this article subject such person or entity to the general penalty provisions of borough ordinances, and nothing stated herein shall preclude the Municipal Court of the Borough of Fort Lee from jurisdiction.
