Editor's Note: Ord. No. 2014-22, adopted 6-12-2014, repealed certain provisions of this article requiring a set-aside of affordable housing for development. See § 410-93.
The purpose of the R-10A High-Rise Apartment Residential Zone is to promote the orderly and comprehensive redevelopment of designated areas to multifamily uses in mid- and high-rise structures that promote affordable housing in accordance with the adopted housing element of the Master Plan and the Borough's Fair Share Plan.
The following uses only shall be permitted in an R-10A Zone:
A. 
Principal uses. Any principal uses permitted in the R-10 Zone and two-family uses as permitted in the R-4 Zone.
B. 
Accessory uses. Any accessory uses permitted in the R-10 High-Rise Apartment Residential Zone or customarily incidental to any principal use, including but not limited to recreation areas and facilities and private parking garages and off-street surface parking.
C. 
Conditional uses. Any conditional uses permitted in the R-10 High-Rise Apartment Residential Zone.
D. 
Required uses. Any development within the R-10A Zone shall set aside a minimum of 20% of its total number of dwelling units for affordable housing in accordance with Article XIV, Affordable Housing Standards, of this Chapter 410 of the Code of the Borough of Fort Lee. Developments of one- and two-family dwellings shall be exempt from this requirement.
The following regulations shall apply to any development within the R-10A Zone:
A. 
One- and two-family uses: as required in R-4 Districts.
B. 
Mid-rise apartment building.
(1) 
Minimum lot area: 43,560 square feet.
(2) 
Minimum lot area per family: 870 square feet.
(3) 
Minimum lot width: 100 feet.
(4) 
Minium lot depth: 100 feet.
(5) 
Minimum front, side and rear yards, principal building: 25 feet.
(6) 
Minimum front, side and rear yards, accessory buildings and structures, excluding private parking garages: see § 410-35.
(7) 
Minimum front, side and rear yards, private parking garages: 5 feet, provided that such structures do not exceed three levels of parking above grade. Private parking garages that exceed three levels of parking shall comply with the provisions of § 410-43.
(8) 
Maximum height: 70 feet or six stories, whichever is less.
(9) 
Maximum density: 50 dwelling units per acre.
(10) 
Maximum lot coverage: 30%.
C. 
High-rise apartment building.
(1) 
Minimum lot area: 43,560 square feet.
(2) 
Minimum lot area per family: 870 square feet.
(3) 
Minimum lot width: 150 feet.
(4) 
Minimum lot depth: 150 feet.
(5) 
Minimum front, side and rear yards, principal building: see § 410-28F.
(6) 
Minimum front, side and rear yards, accessory buildings and structures: see § 410-35.
(7) 
Maximum height: 120 feet or 11 stories, whichever is less, measured from elevation of intersecting center lines of Kaufer Lane and Cedar Street.
(8) 
Maximum density: 50 dwelling units per acre.
(9) 
Maximum lot coverage: 23%.
The following regulations shall apply to any development within the R-10A Zone:
A. 
One- and two-family dwellings: in accordance with R-4 Zone one- and two-family dwelling requirements.
B. 
Mid-rise apartment building.
(1) 
Minimum parking spaces: 1.63 spaces per dwelling.
(2) 
Maximum compact parking spaces: 30% of total spaces.
(3) 
Off-street loading: one off-street loading berth in compliance with § 345-21 of Chapter 345, Site Plan Review, of the Code of the Borough of Fort Lee or adequate demonstration to the satisfaction of the Planning Board that adequate provision for the loading and unloading of supplies and solid waste has been made.
C. 
High-rise apartment building: in accordance with R-10 Zone high-rise apartment requirements.
