A. 
It is in the public interest to ensure that the public roadways and rights-of-way are kept clear of snow, ice, grass, leaves, sticks, branches, and other similar materials.
B. 
The placement of snow, ice, grass, leaves, sticks, branches, and other similar materials in public rights-of-way or roadways can cause a public safety hazard.
C. 
The removal of snow, ice, grass, leaves, sticks, branches, and similar materials by residents of the Township of Franklin from their property and the placement of same on the public rights-of-way and roadways may impede the Department of Public Works in its efforts to maintain said roadway, cause traffic problems and otherwise interfere with the public health, safety and welfare.

A. 
It shall be unlawful for any person or his or her agent or employee to allow or to place, shovel, brush, mow or blow, or in any other manner cause or allow to remain snow, ice, grass, leaves, sticks, branches, or items of similar materials on any public roadway or rights-of-way located within the Township of Franklin.
B. 
It shall be a rebuttable presumption that snow, ice, grass, leaves, sticks, branches or similar materials violating the standards herein found in the road in close proximity to a driveway were placed in the road by the owner of the premises, or his or her agent or employee, wherein the driveway is located and is the responsible party for the placement of the snow, ice, grass, leaves, sticks, branches or similar materials in the roadway.
This chapter shall be enforced by the police of the Township of Franklin.
Any person who shall violate this chapter shall be subject to the penalties in Chapter 1, Article I, General Penalty, on such terms and in such form as the court may deem appropriate.
