As used in this chapter, the following terms shall have the meanings indicated:
LANDSCAPERS
Any person, partnership, corporation, limited liability company or any other entity which is engaged in the business of landscaping, lawn maintenance, irrigation or gardening, for a fee or for profit. This shall not include casual employment by minors or casual employment by family members.
A. 
No person shall engage in the business of landscaping without first obtaining a license therefor.
B. 
Every applicant for a license under this chapter shall sign an application on forms furnished by the Building Department.
The license fee shall be $100 per year for each landscaper, as defined in § 187-1 above, regardless of the number of trucks or employees. No part of said fee shall be prorated for any part of the year. Upon payment of the fee, the Building Department shall issue an identification badge or sticker for the calendar year for which the application was filed, which shall be affixed to the vehicle and visibly displayed.
Any person who violates any provisions of this chapter shall, upon conviction thereof, be subject to a fine as set in Ch. 1, Art. II, General Penalty, of this Code.

A. 
All landscapers shall provide for the removal of lawn clippings and other landscaping debris and shall not leave or deposit said debris at the curbside or any other site in the City of Garfield. Any landscaper who causes said lawn clippings or landscaping debris to remain on the site or curbside or anywhere in the City of Garfield shall forfeit his license to conduct his landscaping business anywhere in the City of Garfield and shall also be subject to the penalties provided in this chapter.
B. 
The landscaper licensed hereunder shall specifically be required to comply with the Stormwater Management Regulations[1] of the City of Garfield and, specifically, the article entitled "Containerized Yard Waste."

A. 
No landscaper, as defined in this chapter, shall be allowed to perform activities set forth herein within the City of Garfield on Sunday or on the following holidays: New Year's Day, Memorial Day, Independence Day (July 4), Labor Day, Thanksgiving Day, Christmas Day, unless an exemption is sought and obtained from such work from the City of Garfield. Nothing contained in this chapter shall be considered as prohibiting an emergency situation necessary for the preservation of health and safety on Sundays.
B. 
During the days of Monday through Saturday, no activities shall commence before 7:00 a.m. and shall end at sundown.
