This chapter is enacted to regulate the sale and transportation of alcoholic beverages in the Borough of Glen Rock in accordance with the provisions of an act of the Legislature of the State of New Jersey entitled "An Act Concerning Alcoholic Beverages," comprising Chapter 436 of the Laws of 1933, its supplements and amendments, and also comprising N.J.S.A. 33:1-1 et seq., and in accordance with the rules and regulations of the State Director of Alcoholic Beverage Control.
For the purposes of this chapter, words and phrases shall have the meanings given in N.J.S.A. 33:1-1 et seq. and the rules and regulations of the Director of Alcoholic Beverage Control.
All applications for licenses, all licenses issued and all proceedings under this chapter shall be in accordance with the act, rules and regulations referred to in § 66-1 and all other applicable laws of the State of New Jersey or of the United States.
All licenses required by this chapter shall be issued by the governing body, which shall also administer the provisions of this chapter.
No person shall sell or distribute alcoholic beverages within the Borough without having obtained a license in accordance with the act referred to in § 66-1 and the provisions of this chapter.

The annual license fees shall be as provided in Chapter 101, Fees, and the maximum number of licenses for the sale or distribution of alcoholic beverages in the Borough shall be as follows:

The sale of alcoholic beverages from all licensed premises on any day of the week except for Saturdays, Sundays, Christmas Eve, Christmas Day, New Year's Eve and New Year's Day shall be limited to the following hours:
A. 
Plenary retail consumption, limited distribution and club licensees:

(1) 
Monday through Thursday: between the hours of 9:00 a.m. and 1:00 a.m. of the following day.
(2) 
Fridays: between the hours of 9:00 a.m. to 2:00 a.m. of the following day.
B. 
Plenary retail distribution licensees: between the hours of 9:00 a.m. and 10:00 p.m.

The sale of alcoholic beverages from all licensed premises on Saturdays and Sundays shall be limited to the following hours:
A. 
Plenary retail consumption, limited distribution and club licensees.
(1) 
Saturdays: between the hours of 9:00 a.m. and 2:00 a.m. of the following day.
(2) 
Sundays: between the hours of 9:00 a.m. and 2:00 a.m. of the following day.

B. 
Plenary retail distribution licensees.
(1) 
Saturdays: between the hours of 9:00 a.m. and 10:00 p.m.
(2) 
Sundays: between the hours of 9:00 a.m. and 6:00 p.m.

The sale of alcoholic beverages from all licensed premises on Christmas Eve, Christmas Day, New Year's Eve and New Year's Day shall be limited to the following hours:
A. 
Plenary retail consumption, limited distribution and club licensees.
(1) 
Christmas Eve and Christmas Day: between the hours of 9:00 a.m. and 3:00 a.m. of the following day.
(2) 
New Year's Eve and New Year's Day: between the hours of 9:00 a.m. and 4:00 a.m. of the following day.
B. 
Plenary retail distribution licensees.
(1) 
Christmas Day and New Year's Day: between the hours of 12:00 noon and 6:00 p.m.
(2) 
Christmas Eve and New Year's Eve: between the hours of 9:00 a.m. and 10:00 p.m.

A. 
Nothing contained in §§ 66-7 through 66-10 is intended to permit plenary retail consumption licensees to sell alcoholic beverages in original containers, other than malt alcoholic beverages and wines for off-premises consumption, except during such hours as hereinbefore set forth permitting such sales by plenary retail distribution licensees.
B. 
Nothing contained in §§ 66-7 through 66-10 is intended to prohibit the sale of malt alcoholic beverages and wines in original containers for off-premises consumption by both plenary retail consumption and plenary retail distribution licensees or the sale by limited distribution licensees of malt alcoholic beverages in original containers for off-premises consumption during any hour in which on-premises, open container (drink) consumption is permitted hereunder.
No person shall be served alcoholic beverages in any room which is not open to the public. This section shall not apply to club licenses.
All licensed premises other than those for which club licenses are issued shall be so located that a normal-sized adult may, on inspection from the exterior, view the interior of the premises.
A. 
Any license issued under this chapter may be suspended or revoked for violation of any of the provisions of this chapter or any provision of any applicable statute or any of the rules or regulations of the State Director of Alcoholic Beverage Control.
B. 
Proceedings for suspension or revocation shall be in accordance with the provisions of N.J.S.A. 33:1-31 by service of a five-day notice of charges preferred against the licensee and affording a reasonable opportunity for hearing. Suspension or revocation of a license shall be in addition to any other penalty which may be imposed for a violation of this chapter.
