Township of Kingwood, NJ Chapter 51 Alcoholic Beverages

§ 51-1 Statutory authority.

This chapter is enacted under the authority granted by N.J.S.A. 33:1-1 et seq., An Act Concerning Alcoholic Beverages, being P.L. 1933, c. 436, as supplemented and amended, and in accordance with the rules and regulations promulgated by the Director of the Division of Alcoholic Beverage Control of the State of New Jersey and other applicable laws of the State of New Jersey.

§ 51-2 Definitions.

For the purpose of this chapter, words and phrases herein shall have the same meanings as they have in N.J.S.A. 33:1-1 et seq. and the rules and regulations of the Director of the Division of Alcoholic Beverage Control, as supplemented and amended.

§ 51-3 Administrative authority.

The Township Committee of the Township of Kingwood, being the governing body of said municipality, shall constitute the authority for the issuance of licenses and shall otherwise administer the provisions of this chapter.

§ 51-4 License required.

It shall be unlawful to sell or distribute alcoholic beverages in the Township of Kingwood without a valid license currently in effect, or contrary to the provisions of this chapter or applicable state laws and regulations.

§ 51-5 Classes of licenses; fees.

A. There shall be three classes of licenses issued in the Township of Kingwood, as follows:

(1) Plenary retail consumption.

(2) Plenary retail distribution.

(3) Club.

B. The annual fee for a plenary retail consumption license or a plenary retail distribution license for the license year beginning July 1, 2005, shall be $2,400. Each and every year thereafter, beginning with the license year of July 1, 2006, the annual fee for such license shall be $2,500.

C. The annual fee for a club license shall be $100.

§ 51-6 Hours of sale.

A. Retail consumption sales hours. No alcoholic beverage shall be sold, served, delivered or consumed on any licensed premises between the hours of 2:00 a.m. and 12:00 noon on Sunday and between the hours of 2:00 a.m. and 6:00 a.m. on other days, except as hereinafter provided.

B. Retail package sales hours.

(1) The sale of alcoholic beverages in original containers by plenary retail distribution licensees for consumption off the licensed premises shall be permitted during the following hours:

(a) Sunday: between the hours of 10:00 a.m. and 10:00 p.m.

(b) Monday through Saturday: between the hours of 9:00 a.m. and 10:00 p.m.

(2) In addition, the sale of wine and malt alcoholic beverages in original bottle or can containers for consumption off the premises shall be permitted during the hours authorized by state law and regulations.

C. Club license hours. No club licensee shall sell, serve or deliver or allow, permit or suffer the sale, service, delivery or consumption of any alcoholic beverage on the licensed premises during hours or on days when plenary retail consumption licensees in the Township of Kingwood are prohibited from such activity by this chapter.

§ 51-7 Violations and penalties.

Except as otherwise provided in N.J.S.A. 33:1-1 et seq., any person violating any provision of this chapter shall, upon conviction thereof, be subject to the penalty provisions in Chapter 1, General Provisions, Article II, General Penalties, of the Township Code. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.
