No person or entity, or his, her or its agent, contractor or employee, shall place, move, put or cause, allow or permit to be placed, moved or put by plow, shovel, brush, rake, snowblower or in any other manner, snow, ice or similar materials into, on or across any public roadway or right-of-way located within the Township of Kingwood except while in the actual act of removing such material. No removal activity shall result in the diminution or lessening of the width of any roadway, public right-of-way or cartway, nor the impairing of any site distances, nor the blocking of any drainage structure or facility within the road right-of-way.
It shall be presumed, unless credible evidence to the contrary is submitted by the owner, tenant or occupant of the property or the party accused of the violation, when snow, ice or similar materials are found in the road right-of-way in close proximity to the driveway that the owner, tenant or occupant of the property wherein the driveway is located is the responsible party for the placement of the snow, ice or similar material in the roadway.
A. 
Any person, firm, corporation or association violating this article shall be subject to the penalty provisions in Chapter 1, General Provisions, Article II, General Penalties, of the Township Code.

B. 
This article shall be enforced by the Code Enforcement Officer of the Township of Kingwood or the Superintendent of the Department of Public Works or the New Jersey State Police or such other official designated by the Township Committee.
