[Adopted 10-27-1993 by Ord. No. 93-30]
Pursuant to N.J.S.A. 40:49-4, ordinances of the Township of Manalapan, adopted by the Township Committee of the Township of Manalapan, as revised, codified and consolidated into Chapters herein, shall consist of Chapters 1 through 264 of the "Code of the Township of Manalapan," (hereinafter "Code") together with the appendix and index.
This codification shall supersede and repeal all of the general and
permanent ordinances of the Township of Manalapan adopted prior to December
31, 1992, except as provided herein.
The effect of the proposed changes contained in the codification to
be adopted by this ordinance is as follows:

by reference the "Retail Food Handling Code of New Jersey (1965)." It sets
forth licensing requirements and fees in connection with the various types
of establishments.

Chapter 256. SEWAGE DISPOSAL. This chapter adopts standards relating to individual sewage disposal systems. It adopts by reference the code known as the "Standards for Individual Subsurface Sewerage Disposal Systems (1989)." It requires a permit for the location, construction and alteration of any sewage disposal system to be issued by the Board of Health. It requires a certificate of compliance to be issued by the Board of Health before disposal systems are operated or new dwellings, buildings or additions are sold or occupied. It also requires that a license be issued to any person engaged in cleaning or emptying septic tanks. It provides that a hearing be held upon request of the applicant when a permit or certificate is denied. Provisions setting forth standards relating to sewage disposal systems, abandonment of individual systems and standard for the construction of sewerage facilities are continued except that fees are added for the application of plans and inspection of the construction or alteration of a disposal system, for witnessing soil logs or percolation tests, and for licenses to operate a disposal system.

Chapter 260. SWIMMING POOLS, PUBLIC. This chapter continues existing
regulations concerning public swimming pools. This chapter provides for enforcement
under the swimming code of New Jersey (1970) except as otherwise provided.

Chapter 264. WATER. This chapter would continue existing Township regulations.

The adoption of the Code of the "Township of Manalapan, New Jersey"
and the repeal and/or amendment of any outstanding ordinances shall not affect
the following, which are expressly saved from repeal:
A.
Any ordinance adopted subsequent to December 31, 1992.
B.
Any right or liability established, accrued or incurred
under any legislative provision prior to the effective date of this Code,
or any action or proceeding brought for the enforcement of such right or liability.
C.
Any offense or act committed or done before the effective
date of this Code, in violation of any ordinance provision, or any penalty,
punishment or forfeiture which may result therefrom.
D.
Any prosecution, indictment, action, suit or other proceeding
pending, or any judgment rendered, prior to the effective date of the Code
brought pursuant to any ordinance provision.
E.
Any franchise, license, right easement or privilege heretofore
granted or conferred.
F.
Any ordinance providing for the laying out, opening,
altering, widening, relocating, straightening, establishing grade, changing
name, improvement, acceptance or vacation of any right-of-way, easement, street,
road, highway, park or other public place or any portion thereof.
G.
Any ordinance or resolution appropriating money or Township
funds, promising or guaranteeing the payment of money or authorizing the issuance
and delivery of any bond or other instruments or evidence of the Township's
indebtedness.
H.
Ordinances authorizing the purchase, sale, lease or transfer
of property, or any lawful contract or obligation.
I.
The levy or imposition of taxes, assessments or charges.
J.
The dedication or property or approval of preliminary
or final subdivision plats.
K.
Ordinances establishing the amount and manner of payment
of salaries or compensation and benefits of officers and employees; establishing
workdays, rules and working hours of certain employees; and providing for
holidays and vacations for employees and keeping of employment records.
L.
Any ordinance making any change or revision in the Zoning
Map.
M.
Any ordinance regulating motor vehicles and/or traffic.
All ordinances or parts of ordinances adopted and enforced on the effective
date of the "Code of the Township of Manalapan, New Jersey" are hereby repealed
as of the effective date of the adopting ordinance of the "Code of the Township
of Manalapan, New Jersey," except as herein provided.
In compiling and preparing the "Code of the Township of Manalapan, New
Jersey," pursuant to N.J.S.A. 40:49-1 et seq., certain grammatical changes
and other minor changes were made in the "Revised General Ordinances of the
Township of Manalapan" and other ordinances not so codified, amended and supplemented.
It is the intention of the Township Committee that all such changes be adopted
as part of this Code. In addition, various substantive amendments have been
made to the "Revised General Ordinances of the Township of Manalapan," as
amended and supplemented and it is the intention of the Township Committee
that these amendments be adopted as part of the "Code of the Township of Manalapan,
New Jersey."
Any and all additions, amendments or supplements to this Code, when
passed and adopted in such form as to indicate the intent of the governing
body to make them a part thereof, shall be deemed to be incorporated into
such Code so that references to the "Code of the Township of Manalapan, New
Jersey" or "Code" shall be understood and intended to include such additions
and amendments. Whenever such additions, amendments and supplements to this
Code shall be adopted, they shall thereafter be printed, and as provided herein,
inserted in the loose-leaf book containing the "Code of the Township of Manalapan,
New Jersey" as amendments and supplements thereto.
The Clerk of the Township of Manalapan, pursuant to law, shall cause
a copy of the adopting ordinance for the "Code of the Township of Manalapan,
New Jersey" to be published in the manner required. Sufficient copies on the
"Code of the Township of Manalapan, New Jersey" shall be maintained in the
office of the Clerk for inspection by the public at all times during regular
office hours. The enactment and publication of the adopting ordinance, coupled
with the availability of copies of the "Code of the Township of Manalapan,
New Jersey," for inspection by the public, shall be deemed, held and considered
to be due publication of all provisions of the "Code of the Township of Manalapan,
New Jersey" for all purposes.
It shall be unlawful for anyone to improperly change or amend, by additions
or deletions, any part or portion of the "Code of the Township of Manalapan,
New Jersey" or to alter or tamper with such Code in any matter whatsoever
which will cause the law of the Township of Manalapan to be misrepresented
thereby.
It shall be the duty of the Township Clerk or someone authorized or
directed by her, to keep up-to-date, the certified copy of the book(s) containing
the "Code of the Township of Manalapan, New Jersey" required to be filed in
her office for the use of the public.

All changes in said "Code of the Township of Manalapan, New Jersey"
and all ordinances adopted subsequent to the effective date of this codification,
which shall be adopted specifically as part of the "Code of the Township of
Manalapan, New Jersey" shall, when finally adopted, be inserted therein. Only
such changes or new ordinances which are printed as supplements to such "Code
of the Township of Manalapan, New Jersey" book(s) shall be inserted therein.

A copy of the "Code of the Township of Manalapan, New Jersey" in loose-leaf
form shall be filed in the office of the Township Clerk and shall remain there
for use and examination by the public and, if the adopting ordinance is adopted,
such copy shall be certified to by the Township Clerk of the Township of Manalapan
by impressing thereon the seal of the Township as provided by law, and such
certified copy shall remain on file in the office of the Township Clerk to
be made available to persons desiring to examine same during all times while
the subject Code is in effect.
Copies of the Code book(s) containing the "Code of the Township of Manalapan,
New Jersey" may be purchased from the Township Clerk, upon payment of a fee
to be established by resolution of the Township Committee, which shall also
establish by resolution, the purchase price of the periodic supplementation
of same. Nothing contained herein shall obligate the Township Clerk to make
copies of the Code books available for sale to the public except as provided
herein.
The adopting ordinance and the "Code of the Township of Manalapan, New
Jersey" shall supersede all provisions of the "Revised General Ordinances
of the Township of Manalapan, New Jersey" as amended and supplemented, except
as provided herein.
If any chapter, article, section, subsection, paragraph, subparagraph,
sentence or clause of the "Code of the Township of Manalapan, New Jersey"
be declared constitutionally invalid, unenforceable or inoperative, in whole
or in part, by a court of competent jurisdiction, no such determination shall
be deemed to invalidate the remaining chapters, articles, sections, subsections,
paragraphs, subparagraphs, sentences or clauses of the "Code of the Township
of Manalapan, New Jersey."
All ordinances or parts of ordinances inconsistent with this ordinance
are hereby repealed to the extent of such inconsistency.
This ordinance shall take effect upon due publication according to law.
