A. 
All regular full-time employees of the Township shall not be required to work but shall receive pay for the following holidays:

New Year's Day.
(2) 
Martin Luther King's birthday.
(3) 
Washington's birthday.
(4) 
Good Friday.
(5) 
Decoration Day.
(6) 
Independence Day.
(7) 
Labor Day.

Columbus Day.
(9) 
Veterans Day.
(10) 
Thanksgiving.
(11) 
Day after Thanksgiving.
(12) 
Christmas.
B. 
When any of the above legal holidays fall on a Saturday or Sunday, the holiday shall be celebrated on the Friday before or the Monday after.
C. 
In order to be entitled to the above paid holidays, the employees must work the regular workdays before or after the holiday, except if a holiday falls within an employee's vacation, in which event the employee will receive an additional day of vacation.
D. 
Every municipal employee shall be entitled to up to three personal days per year with pay for the purpose of conducting personal business which ordinarily could not be attended to during normal hours. These days cannot be concurrent with vacations, holidays or leaves of absence and must be approved in advance by the employee's immediate supervisor or department head with the concurrence of the Municipal Administrator.
E. 
Where it is necessary to maintain service requiring an employee to work on an official holiday, that employee shall be compensated by being permitted to take an equal amount of time off with pay on a regular working day at a time approved by the Municipal Administrator or receive compensation.
F. 
Due to the emergency nature of the Police Department, the provisions of this section shall not be applicable to members of the Police Department.
G. 
In the event that an official holiday is observed during an employee's vacation, he shall be entitled to an additional vacation day, and should an official holiday occur while an employee is on sick leave, he shall not have that holiday charged against his sick leave.
H. 
Employees are entitled to two floating holidays each year. These floating holidays represent Lincoln's Birthday and Election Day. Employees will be entitled to one floating holiday as of January 1 of the respective year and one additional floating holiday as of July 1 of each year. Unused floating holidays will not accrue from year to year, and unused floating holidays at year's end will not be compensated.

A. 
Accurate and complete time and attendance records shall be maintained by each departmental unit of the Township. The head of the department will certify as to the accuracy of the time and attendance records to the Township Treasurer at the end of each month.
B. 
All Township employees are to be at their assigned posts ready for work as specified by the Municipal Administrator unless on vacation, leave of absence or absent for good cause.
C. 
Being punctual is of the utmost importance; consequently, any lateness and the reason for it will be noted on the time record. Recurring or chronic lateness will be referred to the Municipal Administrator for appropriate action and shall be the basis for disciplinary action against the offending employee.
D. 
It is the responsibility of each employee to notify his department Director without delay if he will be absent from or delayed in reaching his assigned post. If unable to reach the department head, the employee shall notify the Municipal Administrator. Failure to report when absent is a serious offense which cannot be tolerated and may lead to disciplinary action or dismissal by the Municipal Administrator. It is the responsibility of each supervisor to know, at all times, the whereabouts of every member of his group.
E. 
Lunch periods shall be specified by the department head, making certain that duty stations will be covered during the period. The normal time allowed for lunch for employees in Township offices is one hour. Tardiness in returning from lunch is not permitted unless authorized in advance by the department head.
F. 
The regular workweek for full-time clerical Township employees is five days, Monday through Friday, 8:30 a.m. to 4:30 p.m. For other than clerical personnel, all other departments may set their separate working hours, subject to the approval of the Municipal Administrator.

G. 
The Township Administrator, with the approval of the Township Committee, may vary, on a week's notice to the affected parties, the regular workweek and regular workweek hours for any clerical and other nonsupervisory employee, in the absence of any contrary collective bargaining provision, in order to meet an emergent, temporary or seasonal need in any office or department, to which the employee is assigned, including, but not limited to, the need to meet workload needs and maintain efficiency during a temporary shortage of personnel or a temporary excessive increase in workload or a temporary change in the priority of activities in the office or department. This flexible scheduling by the Administrator shall continue until the emergent, temporary or seasonal need in the affected office or department has ceased.
All salaried and hourly employees (other than the Director, superintendents, foreman and any and all other supervisory employees) within the Department of Public Works and Utilities shall be paid 1 1/2 times the hourly rate for all time worked in excess of eight hours per day. As to the Water and Sewer Utility, overtime will be limited to emergency work only.
A. 
Overtime work shall be kept to a minimum, and, except in cases of emergency, must be authorized in advance by the department head, with the concurrence of the Municipal Administrator. Records shall be kept of all overtime and filed with the Municipal Treasurer monthly.
B. 
Hourly employees in the Road Department who work in excess of 40 hours in the workweek will be paid overtime at the rate of time and a half of their base hourly rate.
C. 
In computing overtime compensation, the nearest quarter hour shall be the smallest fraction of an hour to be reported.
D. 
Executive, administrative and supervisory employees shall not be entitled to overtime compensation.
E. 
Overtime or extra work performed in addition to regular duties shall be compensated in the following manner:
(1) 
Nonclerical employees. These employees shall be compensated at the rate of 1 1/2 times the regular rate in each instance for all overtime over 40 hours' work in any workweek. Sick leave time allowed or taken in any workweek shall be considered a part of the forty-hour base period.
(2) 
Clerical employees. These employees shall be required to work up to 40 hours in any workweek when required to do so by the Director of the department without any overtime or extra compensation. For all work or services over 40 hours in any workweek, exclusive of sick leave time allowed or taken, clerical employees shall be compensated at the rate of 1 1/2 times the regular rate in each instance.
(3) 
Executive, administrative and supervisory employees. These employees shall not be entitled to overtime compensation at any time, except that the Director of each department shall have the authority, when special or emergency conditions require it, to order any such employees to be paid extra compensation for extra services in such amount as the Director, governing body and Municipal Administrator shall approve.
F. 
No overtime compensation shall be paid except for overtime services rendered upon the authorization and direction of the head of the particular department.
G. 
Professional, technical and other special services allowed by law shall be engaged and the compensation fixed by the governing body.
H. 
The foregoing provisions shall not apply to the members of the Police or Fire Departments.
A. 
Amount.

(1) 
All permanent employees shall be granted the following annual leave for vacation purposes with pay, in and for each calendar year, except as otherwise herein provided:
(a) 
Following appointment as a probationary employee, the employee shall earn one vacation day for each month worked.
(b) 
After one year and up to five years of service: 12 working days vacation.
(c) 
After five years and up to 10 years of service: 15 working days vacation.
(d) 
After 10 years of service and up to 15 years of service: 18 working days vacation.
(e) 
After 15 years of service and up to 20 years of service: 20 working days vacation.
(f) 
After 20 years of service: 25 working days vacation.
(2) 
Earned vacation may not be taken or used for a period of six months from the date of appointment as a probationary employee and until such time as the employee is appointed to permanent status.
(3) 
Where in any calendar year the vacation or any part thereof is not granted by reason of pressure of the Township, the vacation periods or parts thereof not granted shall accumulate and shall be granted during the next succeeding calendar year only.
(4) 
Department heads who do not receive compensatory time or overtime shall be entitled to five extra vacation days each calendar year.
(5) 
The Assistant Administrator. Tax Collector and Tax Assessor shall be entitled to up to five days' worth of compensatory time at the discretion of their department head for hours worked beyond the routine work day.
(6) 
Permanent employees with more than one year of service may take the full amount of annual leave for vacation at any time during the calendar year, although the annual leave for vacation shall actually accrue on the last day of each month from January through August at the rate per month of 1/12 the total annual leave for vacation. However, the total annual leave for vacation shall accrue as of September 1 of the calendar year. An employee's final paycheck shall be adjusted for annual leave still owed to the employee or for excess annual leave taken by the employee.
B. 
All vacations must be scheduled by the department Director and approved by the Municipal Administrator. It is his responsibility to schedule individual vacations so that activities of the Township will be carried on with a minimum of interruption and inconvenience. Employees with seniority will be given first preference in assignment of vacations insofar as possible.
C. 
Temporary employees are not eligible for vacation benefits. Part-time employees will receive vacation benefits on a prorated basis.
D. 
Executive employees' vacations may vary in length depending on specialized qualifications, age and length of appointment, to be determined by the governing body.
E. 
Unless specifically authorized by the governing body in advance, extra compensation will not be allowed in lieu of unused vacation, as it is desired that each employee take advantage of the authorized annual vacation period for health, rest, relaxation and pleasure.
F. 
Vacation. Upon the death of an employee while in the service of the Township, the employee's beneficiary shall be entitled to payment for all unused vacation days earned as of the date of death.
A. 
There shall be no entitlement for payment for accumulated sick leave upon termination of employment.
B. 
Only full-time employees shall be entitled to sick leave with pay of not less than one working day for every month of service during the remainder of the first calendar year of service following permanent appointment and 15 working days in every calendar year thereafter, not to exceed one day for each month worked. Sick leave may be allowed to accumulate indefinitely to provide for medical conditions that require extensive rehabilitation only. Credit for prior service shall be allowed.
C. 
In order to qualify for sick leave of three days or more, the absence of an employee must be properly certified by a physician or hospital. In case of sick leave due to a contagious disease or exposure to same, a certificate from the local Department of Health shall be required.
D. 
Sick leave is paid leave that may be granted to each full-time employee who is unable through sickness or injury to perform the duties of his position or who is quarantined by a physician because he has been exposed to a contagious disease.
E. 
All absences due to illness or disability shall be reported immediately by or for the employee to his department Director or the Municipal Administrator.
F. 
In all cases of reported illness or disability, the Township reserves the right to send a visiting nurse or the Township medical officer to investigate the report. The Township reserves the right to have any employees reported or reporting as ill or sick to be examined by a physician designated by the Township. The Township may require any employee who has been off duty for a longer continuous period than 10 days to furnish the Township with a physician's certificate that the employee is physically fit and able to resume his duties, and the Township shall also have the right to have such employee examined physically by a physician of its own choice to determine whether or not the employee is able to resume his duties and employment.
G. 
Sick leave cannot be allowed for ordinary dental care nor for the services of an oculist for normal eye care, as such professional services are readily available outside of work hours.
H. 
An employee who is certified as absent on account of a disability or accident caused in the usual course of his employment and directly in the line of duty shall not have such absence charged against his sick leave. All other provisions regarding absence on account of sickness or disability apply to employees suffering job disability or accident.
I. 
When an absence due to illness does not exceed three days, normally the employee's statement of the cause will be accepted without a supporting statement from his attending physician. The Township reserves the right to have the employee examined by the Township medical officer before returning to duty.
J. 
No employee while on sick leave from the Township shall be elsewhere or otherwise employed or engaged in any outside work or employment whatsoever.
K. 
Detailed records of such leave per employee are to be maintained by the payroll department.
L. 
Full time employees, not represented by a collective bargaining unit, shall be eligible for sick leave allowance payable on or about July 1 and December 31 of each year equal to 1 1/2% of their base salary on those dates for each preceding six months they are continuously employed by the Township and use three or fewer sick or accumulated sick days. The foregoing provision shall be retroactive to January 1, 1991.
M. 
Nonunion employees who retire with 25 years of service with at least 15 of those years employed by Manalapan Township full-time shall be entitled to payment at their then per-diem rate for unused, accrued sick leave, not to exceed $15,000 upon retirement from a state-administered pension plan.
