Smoking, as defined in § 40-8 of this chapter, is prohibited on all Town/Village properties, including the following:
A. 
Smoking is prohibited throughout the municipal facilities except in designated outside areas identified by "Smoking Permitted" signs.
B. 
Smoking is prohibited in any indoor area.
C. 
Smoking is also prohibited in conference or meeting rooms and municipal vehicles.

Conflicts should be brought to the attention of the appropriate supervisory personnel. Employees may also file a formal complaint with the county enforcement officer.
Employees found smoking outside of designated smoking areas will be considered in violation of this chapter and may be subject to disciplinary action.
Copies of these rules will be posted and distributed to all employees and to all prospective employees upon request.
The Town/Village of East Rochester shall be designated an agent to assist in the enforcement of this chapter by notifying employees who are in violation.
This chapter may be amended from time to time by resolution of the Town/Village Board of Trustees. All amendments shall be in conformance with New York State law, and employees will be notified accordingly.

As used in this chapter, the following terms shall have the meanings indicated:
SMOKING
Inhaling and puffing out the smoke of burning tobacco, marijuana and/or a substitute therefor and also the carrying of burning tobacco, marijuana or a substitute therefor in any form, whether in the form of a cigarette, electronic cigarette, cigar or any other fire- and/or smoke-producing device, including pipes.
