As used in this article, the following terms shall have the meanings indicated:
PUBLICLY OWNED OR LEASED GROUNDS, PUBLIC PARKS, PLAYGROUNDS, BALL FIELDS AND ALL OTHER RECREATIONAL AREAS LEASED OR OWNED BY THE TOWNSHIP
Any place or area within the Township upon which the public is invited or upon which the public is permitted and where children gather for recreational activities.
SCHOOL GROUNDS
All property that is owned or leased by the Township adjacent to school buildings.
A. 
Smoking or carrying lighted cigarettes, pipes, cigars and other tobacco products within all publicly owned or leased grounds, public parks, playgrounds, ball fields and all other recreational areas leased or owned by the Township shall be prohibited within the Township of Manalapan, nor shall smoking be permitted on school grounds at any time, including nonschool hours.
B. 
Smoking shall be permitted in all parking areas unless it is expressly indicated by signage that smoking is prohibited.
Any person who has been found to have violated this article shall be subject to the following:
A. 
For an offense by any person, a fine of no less than $50 and a maximum of $1,000 per offense will be issued; or
B. 
At the Judge's discretion, the Judge may suspend the fine in lieu of attendance by the offender, at his or her own expense, in a smoking cessation program recommended by the local Health Department, including the dangers of smoking, tobacco use and secondhand smoke.
The Township will attach permanent signage indicating "Township of Manalapan Smoke-Free Zone" at all such publicly owned or leased playgrounds, school grounds, ball fields and all other public parks and recreation areas leased or owned by the Township.
A. 
This article shall be enforced by any member of the Police Department and/or Police Chief and his/her designee and/or Health Officer and his/her designee of the Township of Manalapan.
B. 
Any citizen may initiate enforcement by registering a complaint with the Police Department or Health Department.
C. 
Any citizen may inform any person perceived to be violating this article of the provisions of this article.
