Township of Manalapan, NJ Article III Discharges into Public Sanitary Sewers

§ 185-10 Prohibited discharges to sanitary sewers.

No person shall discharge or cause to be discharged any storm water, surface water, ground water, roof runoff, subsurface drainage, uncontaminated cooling water and air conditioning/dehumidification condensate water or unpolluted industrial process waters to any sanitary sewer, except as permitted by the order of the Western Monmouth Utilities Authority.

§ 185-11 Stormwater discharge.

Stormwater and all other unpolluted drainage shall be discharged to such sewers as are specifically designated as storm sewers or to a drainage outlet or natural watercourse approved by the Township Engineer, NJDEP and all other regulatory agencies having jurisdiction. Industrial cooling water or condensate or unpolluted process water may be discharged, on the approval of the Township Engineer, NJDEP and all other regulatory agencies having jurisdiction to a storm sewer or drainage outlet or natural watercourse.

§ 185-12 Prohibited discharges to public sewers.

Except as hereinafter provided, no person shall discharge or cause to be discharged any of the following described waters or waste to any public sanitary sewers:

A. Any gasoline, benzene, naphtha, fuel oil or other flammable or explosive liquid, solid or gas.

B. Any water or wastes containing toxic or poisonous solids, liquids or gases in sufficient quantity, either singly or by interaction with other wastes, to injure or interfere with any sewage treatment, constitute a hazard to humans or animals or aquatic biota in the receiving stream or create a public nuisance, including but not limited to cyanides in excess of two milligrams per liter as CN in the wastes as discharged to the public sewer.

C. Any waters or wastes having a pH lower than 5.0 or having any other corrosive property capable of causing damage or hazard to structures, equipment and personnel of the sewer works.

D. Solid or viscous substances in quantities or of such size capable of causing obstruction to the flow of sewers or other interference with the proper operation of the sewage works, such as but not limited to ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar, plastics, wood, unground garbage, whole blood, paunch manure, hair and fleshings, entrails and paper dishes, cups, milk containers, etc., either whole or improperly ground garbage.

E. Any liquid or vapor having a temperature higher than 120° F.

F. Any water or waste which may contain more than 100 mg/l by weight of fat, oil, wax or grease, or containing other substances which may solidify or become viscous at temperatures between 32° F. and 120° F.

G. Any garbage except properly shredded garbage. The installation and operation of any garbage grinder equipped with a motor of 3/4 horsepower or greater shall be subject to the review and approval of the Township and WMUA

H. Have a flash point lower than 235° F. as determined by the Tagliabue (Tag) close cup method.

I. Any ashes, cinders, stones, sand, mud, straw, shavings, or sawdust, metal, sticks, coarse rubbish, glass, rags, tar, feathers, plastics, waste rubber, animal guts or tissues, entrails, blood, hair, hides, wood, paunch manure, disposable diapers or any other substance likely to damage, destroy or cause an obstruction to the flow in any sewer or which may interfere with the proper operation of the sewage works.

J. Any waters, sewage, or wastes having a pH higher than 9.0.

K. Any waters or wastes containing a toxic, poisonous or radioactive substance in sufficient quantity to injure or interfere with any sewage treatment process or constitute a hazard to humans, animals or marine life or create any hazard in the receiving waters. Radioactive wastes or materials may be discharged into a public sewer if Conditions I and II below are met, provided that such discharges are in compliance with applicable WMUA, State or Federal Regulations:

(1) Condition I: Such wastes must be readily soluble or dispersible in water.

(2) Condition II: The gross quantity of all radioactive materials so discharged must not exceed one curie per year.

(3) Condition III: The daily quantity of any radioactive material, if diluted by the average daily volume of sewage discharged into the system from the installation, must not exceed the maximum concentration allowed by regulations of the United States Nuclear Regulatory Commission.

(4) Condition IV: Daily quantities of radioactive materials up to the maximum permitted by the United States Nuclear Regulatory Commission may be so discharged, provided that the total monthly quantities, if diluted by the average monthly volume of sewage discharged from the installation, do not exceed the concentration permissible under Condition III above.

L. Any noxious, malodorous or taste-producing gas, vapor or substance, such as phenols, capable of creating a public or private nuisance, or which may prove toxic to the sewage treatment processes, or which may exceed mandated limits for discharge to receiving waters.

M. Materials which exert or cause:

(1) Unusual concentrations of inert suspended solids, such as but not limited to Fuller's earth, lime slurries and lime residues, or of dissolved solids, such as but not limited to sodium chloride and sodium sulfate.

(2) Excessive discoloration, such as but not limited to dye wastes and vegetable tanning solutions.

(3) Unusual BOD, suspended solids, chemical oxygen demand or chlorine requirements in such quantities as to constitute a significant load on the sewage treatment works.

(4) Unusual volume of flow as concentration of wastes constituting "sludge" or a "slug."

N. Waters or wastes containing substances which are amenable to treatment or reduction by the sewage treatment processes employed, or are amenable to treatment only to such degree that the sewage treatment plant effluent cannot meet the requirements of other agencies having jurisdiction over discharge to the receiving waters.

O. Any substance prohibited by any federal, state, county or municipal regulatory agency or governmental body including but not limited to the Federal Environmental Protection Agency, the New Jersey Department of Environmental Protection, the Western Monmouth Utilities Authority or the Township as set forth or determined by the rules, regulations or requirements of such regulatory agencies or bodies.

P. Any waters or wastes containing strong acid iron pickling wastes or concentrated plating solutions, whether neutralized or not.

Q. Any waters or wastes containing iron, chromium, copper, zinc and similar objectionable or toxic substances or wastes exerting an excessive chlorine requirement to such degree that any such material received in the composite sewage at the sewage treatment works exceeds the limits established by the WMUA and all other regulatory agencies having jurisdiction for such materials.

§ 185-13 Standard measurement.

All measurements, tests and analyses of the characteristics of waters and wastes to which reference is made in this article shall be determined in accordance with the latest edition of "Standard Methods for the Examination of Water and Wastewater," published by the APHA/AWWA/WPCF.

§ 185-14 Agreement.

No statement contained in this article shall be construed as preventing any special agreement or arrangement between the WMUA and any owner of property upon application made and a finding by the WMUA, that such special agreement or arrangement would be in the best interests of the WMUA.

§ 185-15 Other prohibited connections.

No person shall connect or allow to be connected into any part of the sewer system located within the Township of Manalapan any drain, floor drain, foundation drain or drain leader or gutter designed to collect precipitation, ground or surface waters.

§ 185-16 Grease traps.

A. Grease traps shall be installed for all units connected to the public sewer from which large quantities of grease can be expected to be discharged in the opinion of the Plumbing Subcode Official and/or the Western Monmouth Utilities Authority. They shall be installed in separate lines serving that part of a plumbing system from which grease will be discharged. Traps so installed shall be located and constructed in a manner that will reduce the temperature of effluent to permit the congealing or separation of grease. They shall be located and constructed in a manner that will permit access for cleaning.

B. All grease traps shall be designed in accordance with current National Plumbing Code Standards and subject to the final approval of the Western Monmouth Utilities Authority and, upon application for a plumbing permit, shall be revised and inspected by the Plumbing Subcode Official.

C. All grease traps and interceptors shall be maintained properly with maintenance records posted on premises.

D. The owner or operator of the premises on which a grease trap or interceptor is maintained shall clean and maintain said system in accordance with the rules and regulations of the Western Monmouth Utilities Authority. Furthermore, said grease traps or interceptors shall be periodically inspected by the Plumbing Inspector and/or the Western Monmouth Utilities Authority. All maintenance and repair records shall be posted on the premises.

E. This article shall permit Western Monmouth Utilities Authority to recover all costs associated with their services in clearing a blockage due to an oil and grease discharge into a Western Monmouth Utilities Authority sewer line by a local restaurant and food establishment.

§ 185-17 Violations and penalties.

Any person violating this article shall be subject to a fine not exceeding $1,000 or imprisonment for 90 days, or both, in the discretion of the Judge of the Municipal Court of the Township of Manalapan. Every day shall be considered a separate and distinct offense.
