This section shall be known as the "Stormwater Quality Control Regulations of the Township of Manalapan."
It is hereby found that pollutants used in outdoor operations or activities on private property have in many cases contributed significantly to water pollution and that such pollution is detrimental to the health and welfare of the community. It is therefore determined that the special public interest in the control of the quality of stormwater justifies the regulation of property located within the community as provided in this article, which is the exercise of the police power of the municipality for the preservation of the public health, safety and welfare.
No person shall carry out any activity or operation which shall cause pollutants to be discharged whether directly on the land or through a private or municipal drainage system in such concentration or quantity that receiving waters or groundwater sources of water supply become polluted such as to violate state water quality standards. Pollutants shall include but not be limited to grease, oils, chemicals and grit.
Upon complaint or information by any citizen or any municipal employee of the Township, the Township Sanitary Inspector shall investigate the water quality of any direct connection, receiving water or groundwater sources of supply and, if such water quality is below state standards, shall determine the type and source of pollutants where possible.
In the furtherance of the purposes of this article, it shall be a violation thereof for any person to bury an organic, processed organic or nonorganic materials on any lands, except as otherwise permitted by this Code or other applicable law, provided, further, that nothing contained herein, unless as otherwise permitted or limited by this Code or other applicable law, shall prohibit the burying of tree stumps and related tree materials on land parcels not exceeding one acre and used as the residence of the person burying such tree stumps and related tree materials on the land.[1]
