A code regulating and controlling the operation of recreational bathing facilities open to the public and the issuance of licenses to operate recreational bathing facilities open to the public is hereby adopted pursuant to Chapter 188, Laws of 1950 (N.J.S.A. 26:3-69.1 to 26:3-69.6). A copy of said code is annexed hereto and made a part hereof without inclusion of the text thereof herein.
Said code established and adopted by this chapter is described and commonly known as the "Public Recreational Bathing Code," Chapter IX of the New Jersey State Sanitary Code.
Three copies of the Public Recreational Bathing Code have been placed on file in the office of the Secretary to the Board of Health upon introduction of this chapter and will remain on file in said office for use and examination by the public.
No person shall operate a recreational bathing facility open to the public until a license therefor shall have been issued by this Board of Health.

There shall be charged a fee to operate a recreational bathing facility open to the public. Fees shall be charged as follows:
For facilities with one pool, spa, hot tub, therapeutic pool, whirlpool, hydrotherapy pool, bathing beach or wading pool, the fee for a license to operate the facilities shall be $200.

For facilities with more than one pool, spa, hot tub, therapeutic pool, whirlpool, hydrotherapy pool, bathing beach or wading pool in any combination, the license fee shall be $150 for the first bathing structure and $50 for each additional bathing structure up to a maximum license fee of $300.
For the review of plans and the inspections of the construction of new public recreational bathing facilities, the fee shall be $100.
For the review of plans and the inspections of the construction of modifications to an existing licensed public recreational bathing facility, the fee shall be $75.
A license issued for the operation of a recreational bathing facility open to the public shall expire annually on April 30 of the succeeding year. Renewal of licenses shall be submitted together with the required fee prior to May 1.
A license required by this chapter may be denied or suspended by this Board of Health for failure to comply with this chapter. The Board of Health shall afford the person whose license has been denied or suspended an opportunity to be heard in a public hearing.
