The purpose of this article is to regulate future construction of individual subsurface sewage disposal systems for major subdivisions or site plan applications in order to prevent health problems which might otherwise arise from the expanded use of such systems and in order to further protect the environment and fresh water supply in the Township of Manalapan.
No future major subdivision (a land subdivision of more than two lots), or site plan application shall be permitted where the major subdivision or site plan is to be serviced by individual subsurface sewage disposal systems except as hereinafter provided.
Where an applicant desires to obtain major subdivision approval or site plan approval using individual subsurface sewage disposal systems, it shall apply to the Board of Health. Application shall be made in writing to the officer requesting a public hearing before the Board of Health. The request, with all necessary documentation (site plan, soil work, permeability test results), must be presented to the Health Department no later than 14 days prior to the next regularly scheduled Board of Health meeting.
In determining whether or not the applicant has demonstrated compliance with the Standards for Individual Subsurface Sewage Disposal Systems (N.J.A.C. 7:9A), the Board of Health will consider the information as required in N.J.A.C. 7:9A-3.18A-H.

A. 
Before reaching a determination, the Board of Health may acquire and consider a report from the Township Engineer or any other engineer designated by the Board of Health.
B. 
The Board of Health will also acquire and consider a report from the Township Health Officer or the executive officer of the Board of Health.
C. 
If the Board of Health deems it advisable, the Board of Health may procure other expert opinions before reaching its determination. Any reports to be ordered in accordance with the above shall be ordered within 30 days of receipt of an application for permit to be issued in accordance with this article.
D. 
The Board of Health shall render its decision in as timely a manner as possible but shall render a decision not later than 90 days after receipt of the written request for Board of Health approval. If the Board of Health approves an application made pursuant to this article, said approval shall not be construed or deemed an approval with respect to individual sewage disposal system or individual well design.
E. 
Approvals given by the Board of Health shall expire three years from the date of the resolution of approval. The applicant may apply to the Board of Health for a one-year extension of the approval not to exceed a total of two such extensions from the expiration of the original resolution. Any such extension may be made retroactively. The fee for each extension shall be $50.
