As used in this article, the following terms shall have the meanings indicated:
YARD SALE OR FLEA MARKET
The sale of used items offered to the public in an indoor or outdoor display on property normally used for purposes other than such sales, such as residences, vacant lots, commercial properties or other similar areas and also activities generally referred to as "barn sales," "garage sales" or other similar activities.
No property located in the area of the city not zoned for retail sales shall be used for the purpose of operating a yard sale or flea market for more than four days in any calendar year. Any property so designated in Chapter 305, Zoning, as allowing retail sales may be used for the same in excess of this limitation, provided that all appropriate permits and licenses are obtained. It should be the responsibility of the owner or owners of the premises to ensure that the time limitation contained herein is not violated.
No sign advertising any yard sale or flea market as controlled by this article shall be posted more than two hours prior to the commencement of the sale, and all signs shall be removed no more than two hours after its termination. No signs shall be posted on any property, including utility poles, without the permission of the owner thereof. It shall be the responsibility of the person or persons operating the yard sale to comply with this provision.
Any person wishing to operate a yard sale within the City of Franklin shall notify the Franklin Police Department no less than 24 hours prior to the commencement of the sale of the location and proposed time and dates of the yard sale or flea market. Any person operating such a sale and any person attending the same shall comply with all requests and requirements of either the Franklin Police Department or its individual officers with regard to the flow of traffic and parking of vehicles in connection with such a sale.

There shall be a permit required for each day of a yard sale or flea market, said fee to be assessed in accordance with Chapter 160 of the City of Franklin Municipal Code.
