A.
There shall be established a Building, Housing and Land
Use Department.
B.
The functions and duties of the Building, Housing and
Land Use Department shall include but not be limited to:
(1)
Administer and enforce City ordinances and applicable
state codes relating to the construction, use and occupancy of buildings,
structures, and land, including but not limited to the Building Code, the
Construction Code, the Plumbing Code, the Mechanical Code, the Electric Code,
the Elevator Code, the Fire Code, the Municipal Land Use Law, the Zoning Ordinance,
the Subdivision Ordinance, the Housing and Property Maintenance Ordinance,
and the Rent Stabilization Ordinance. In addition, it shall administer and
enforce all ordinances by the terms of which it, or the former Department
of Community Affairs, has been designated as the appropriate City department.
(2)
Provide the administrative staff and support for the
issuance of permits and licenses relative to buildings, structures and land
use as may be required.
(3)
Provide the administration staff and support for the
Planning Board, the Zoning Board of Adjustment, the Rent Stabilization Board
and the Construction Board of Appeals.
(4)
Administer the issuance of permits relative to work as
required by law or City ordinance involving the public right-of-way.
(5)
Maintain all maps, charts, documents and other public
records pertaining to the functions of the Department.
(6)
The performance of such other duties and tasks as may
be assigned by the City Manager.
C.
Subject to the authority of the City Manager, the Department
shall be headed by the Construction Code Official, who shall also serve as
the Zoning Officer. The term "Zoning Officer" shall be deemed to be the equivalent
of "Administrative Officer," as that term is defined by N.J.S.A. 40:55D-3.
A.
All other City employees, including but not limited to
Code Officials, inspectors, technical assistants, administrative personnel,
and clerical personnel, shall be appointed by the City Manager.
All duties previously assigned to the Community Affairs Department are
hereby transferred to the Building, Housing, and Land Use Department.
