An application for a license or permit shall be made by the
person who is to conduct the business, trade, occupation or activity
for which the license or permit is sought, or by the duly authorized
representative of such person.
Unless specifically provided otherwise, all applications shall
be made to the City Clerk, and it shall be the duty of said Clerk
to provide the applicant with such information as may be required.
A.
Unless otherwise provided, applications shall be in triplicate on
forms provided for that purpose by the licensing authority. Such forms
shall indicate the license or permit for which application is being
made, and all applications shall be signed by the applicant.
B.
All applications, regardless of the type of license or permit for
which application is being made, shall require the following information
to be supplied:
(1)
Name and address of applicant. If the applicant is a corporation,
the names and addresses of the president and secretary, in addition
to the name of the authorized representative making application, shall
be given; if a partnership, the names and addresses of all partners
shall be given.
(2)
Name under which the business, trade, occupation or activity is to
be conducted (if applicable), and the address.
(3)
Nature of the business, trade, occupation or activity.
(4)
Business telephone number of the applicant.
(5)
A record of any licenses or permits denied or revoked by the City
of Hackensack.
C.
When deemed necessary by the licensing authority or when specifically
required by ordinance, some or all of the following information shall
be supplied:
(1)
Residences of applicant (if individual) during the past 10 years.
(2)
Social security number.
(3)
Record of any arrests and convictions for misdemeanors and crimes, including the nature of the offense for which arrested and convicted, the date of conviction and the place where said conviction was obtained, for all persons named in Subsection B(1) above.
(4)
Names and addresses of present or former employers (if applicable)
during the past 10 years.
(5)
Name and address of attorney (if applicable).
D.
As determined necessary by the licensing authority or as provided
in other ordinances, the applicant shall be required to:
(1)
Be fingerprinted by the Police Department.
(2)
Submit a recent photograph or photographs of his face, of a size
approximately two inches by two inches.
(3)
Submit no less than two business references, at least one of whom
shall be a resident of Bergen County.
(4)
Submit no less than two personal references, at least one of whom
shall be a resident of Bergen County.
E.
All application requirements provided for in the particular chapter
or ordinance pertaining to the license or permit for which application
is being made shall be complied with in addition to the applicable
provisions of this section.
A.
Upon receipt of the completed application form and any supplementary
information and material, the licensing authority shall inspect the
same and, if all is in order, two copies of the application shall
be referred to the approving authority.
B.
In the course of his investigation and determination as to approval,
the approving authority shall be guided by all applicable statutory
provisions and the ordinances and regulations of the City, and recommendations
as to approval of the application shall be based on the applicant's
compliance with such laws, statutes and regulations and the applicant's
fitness for the business, trade, occupation or activity for which
the license or permit is to be obtained. Where buildings, structures
or premises are to be used in connection with the license or permit,
it shall be determined that the same are in compliance with all applicable
laws, statutes, ordinances and regulations.
C.
Recommendations as to approval of the application shall be made,
in writing, on the application forms, and one copy of said form shall
be returned to the licensing authority.
D.
The report and recommendation of the approving authority shall be
submitted with as little delay as possible, and failure to submit
any such report or recommendation within 10 days of the date of referral
of the application shall be considered as a favorable report or recommendation,
and the licensing authority shall proceed as if such favorable report
or recommendation had been received.
E.
Where no approving authority is designated or involved by way of
responsibility for inspections and enforcement of regulations, the
licensing authority shall proceed with the investigation or may, as
deemed advisable, refer the application to other City officials for
their recommendation.
A.
It shall be the duty of the licensing authority to keep a register
or registers of all applications for licenses and permits and a record
as to the recommendation received and final action taken.
B.
A register of all applications for which investigations and recommendations
were made shall also be kept by the approving authority, with a record
of the recommendation made to the licensing authority.
The applicant must pay for all New Jersey State and Federal
Bureau of Investigation fingerprint record check fees.
