No person shall consume alcoholic beverages on any of the public streets, sidewalks, parking lots, roadways, pathways, playgrounds, parks or quasi-public areas or any other public property whatsoever within the Borough of Haledon at any hour of the day or night unless a special permit is obtained from the Mayor and Municipal Council of the Borough of Haledon.
No persons shall consume any alcoholic beverages while in an automobile, whether in motion or parked, upon any of the public streets, parking lots, roadways, shopping plazas or other thoroughfares open to general vehicular traffic in the Borough of Haledon.
No person shall discard alcoholic beverage containers upon any public street, sidewalks, parking lots, roadways, pathways, playgrounds, parks or quasi-public areas or any other public property whatsoever within the Borough of Haledon at any hour of the day or night.
As used in this article, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Any fluid or solid capable of being converted into a fluid, suitable for human consumption and having an alcoholic content of more than 1/2 of 1% by volume, including alcohol, beer, lager beer, ale, porter, naturally fermented wine, treated wine, blended wine, fortified wine, sparkling wine, distilled liquors, blended distilled liquors and any brewed, fermented or distilled liquors fit for use for beverage purposes, or any mixture of the same and fruit juices.
ALCOHOLIC BEVERAGE CONTAINERS
Any container made of either glass, aluminum, tin, cardboard or any other substance which can or may be used for the purpose of holding alcoholic beverages.

Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $2,000 or by imprisonment for a term not exceeding 90 days, or both.
