As used in this article, the following terms
shall have the meanings indicated:
Any member of the domestic feline species, male, female or
neutered.
Any cat which has attained the age of seven months or which
possesses a set of permanent teeth.
The Borough Clerk, or other official designated by the Borough
Council, to administer the issuance of licenses under the provisions
of this article.
Rendered permanently incapable of reproduction as certified
by a licensed veterinarian.
When applied to the proprietorship of a cat, includes every
person having a right of property or custody in such cat and every
person who has such cat in his possession or who harbors or maintains
a cat or knowingly permits a cat to remain on or about any premises
occupied by that person.
Includes any individual, corporation, partnership, organization
or institution commonly recognized by law as a unit.
Inoculation of cats against rabies and such other infectious
diseases as may be required to be vaccinated for.
A.
All cats shall be inoculated against rabies by a licensed veterinarian in accordance with the latest Compendium of Animal Rabies Vaccines and Recommendations of Immunization, published by the National Association of State Public Health Veterinarians, except as provided for in Subsection C. All cats shall be vaccinated against such other conditions, as may from time to time be promulgated by the State of New Jersey, the County of Passaic or the Borough of Haledon, in a like manner as for vaccination against rabies.
B.
Vaccination certificate. A certificate of vaccination
shall be issued to the owner of each animal vaccinated.
C.
Exemptions. Any cat may be exempted from the requirements
of such vaccination for a specified period of time by the local Board
of Health upon presentation of a veterinarian's certificate stating
that, because of an infirmity or other physical condition or regimen
of therapy, the inoculation of such cat shall be deemed inadvisable.
A.
Cat licenses shall be issued by the Borough Clerk,
commencing on January 1 of each year, upon application therefor and
the payment of the fee of $5 for each neutered cat and $7 for all
other cats.
B.
The owner of any newly acquired cat of licensing age
or any cat which attains licensing age shall make application for
a license tag or sleeve for such cat within 10 days after its acquisition
or age attainment. This requirement will not apply to a nonresident
keeping a cat within the Borough for no longer than 30 days.
C.
Licenses shall be applied for annually during the
month of January, and they shall be valid for a period ending on the
last day of December of the same year. Said licenses are not transferable.
D.
Cats brought into the Borough.
(1)
Any person who shall bring or cause to be brought
into this Borough any cat licensed in another state for the current
year and bearing a registration tag or sleeve and who shall keep the
same or permit the same to be kept within the Borough for a period
of more than 30 days shall immediately apply for a license and registration
tag or sleeve for each such cat for the year in which the cat is brought
into the Borough.
(2)
Any person who shall bring or cause to be brought
into this Borough any unlicensed cat and shall keep the same or permit
the same to be kept within the Borough for a period of more than 10
days shall immediately apply for a license and registration tag or
sleeve for each such cat. Failure to comply with this section will
result in the penalties as outlined in this chapter.
(3)
Only one license and registration tag shall be required
in any licensing year for any cat owned in New Jersey, and any such
license and tag issued by any other municipality of this state shall
be accepted by the Borough of Haledon as evidence of compliance with
this section.
E.
Application; contents; preservation of information.
The application shall state the breed, sex, age, color and markings
of the cat for which the license and registration are sought; whether
it is of a long- or shorthaired variety; the name, street and post
office address of the owner; and the person who shall keep or harbor
such cat. The information on said application and the registration
number issued for the cat shall be preserved for a period of three
years by the Borough Clerk or other official designated to license
cats in the Borough.
F.
License forms and tags. License forms and tags or
sleeves shall be furnished by the Borough and shall be numbered serially
and shall bear the year of issuance and the name "Borough of Haledon."
G.
Evidence of inoculation with a rabies vaccine or certification
of exemption shall be presented to the Borough Clerk prior to the
issuance of any such license, official registration tag or sleeve.
H.
Loss of license. If a license tag or sleeve has been
misplaced or lost, the Borough Clerk may issue a duplicate license
and/or registration sleeve for that particular cat at a fee of $5.
I.
Proof of licensing. Proof of licensing shall be produced
by any person owning, keeping, maintaining or harboring a cat upon
the request of any health official, police officer, animal control
officer or other authorized person.
J.
Removal of tag forbidden; attaching tag wrongfully.
No person, except an official in the performance of his/her duties,
shall remove a registration tag from the collar of any cat without
the consent of the owner, nor shall any person attach a registration
tag to a cat for which it was not issued.
K.
License fees and other moneys collected or received
under the provision of this chapter shall be forwarded to the Borough
treasury and deposited in the general account of the Borough of Haledon.
No person shall hinder, molest or interfere
with anyone authorized or empowered to perform any duty under this
chapter.
A.
Such persons as may be designated by the Borough from time to time shall take into custody and impound or cause to be taken into custody and impounded and thereafter destroyed or disposed of, as provided in Subsections B and C the following:
(1)
Any cat off the premises of the owner or of the person
keeping or harboring the cat which the person charged with the enforcement
of this chapter has reason to believe is a stray cat.
(2)
Any cat without a current registration tag on its
collar or any cat which the person who is charged with the enforcement
of this chapter has reason to believe is diseased.
B.
Notice of seizure; contents; service.
(1)
If any cat so seized wears a collar having inscribed
thereon or attached thereto the name and address of any person or
a registration tag or if the cat has proper identification markings
as herein provided or if the owner or other person keeping or harboring
the cat is otherwise known, the person charged with the enforcement
of this chapter, or any person authorized by him on his behalf, shall
forthwith serve on the person whose address is given on the collar
or the person whose name is registered as the owner or on the owner
or the person keeping or harboring the cat, if otherwise known, a
notice, in writing. The notice shall state that the cat has been seized
and will be liable to be disposed of or destroyed if not claimed within
seven days after service of the notice.
(2)
A notice under this section may be served by delivering
it to the person on whom it is to be served or by leaving it at the
person's usual or last known place of abode or at the address given
on the collar or by forwarding it by post in a prepaid letter addressed
to that person at his usual or last known place of abode or to the
address given on the collar.
C.
Destroying or disposing of cats. When any cat so seized
has been detained for seven days after notice, when notice can be
given as above set forth, or has been detained for seven days after
seizure, when no notice has been given as above set forth, or because
of lack of the name and address of the owner and if the owner or person
keeping or harboring the cat has not claimed the cat and paid all
expense incurred by reasons of its detention and if the cat is unlicensed
at the time of seizure and the owner or person keeping or harboring
the cat has not produced a license and registration tag for the cat,
the designated authority, or any person authorized, may cause the
cat to be destroyed by a humane method.
D.
Pound fee; maintenance charge. For every cat impounded,
there shall be a detention expense charged in the amount of $5 which
shall include maintenance for the first calendar day. Thereafter,
there shall be a maintenance charge for each cat so seized of $3 per
day.
E.
No owner or person keeping or harboring a cat shall
be permitted to claim an impounded cat unless a license and registration
tag can be produced for the cat.
No person shall abandon any dog or cat, no matter
what its age, within the Borough.
