[HISTORY: Adopted by the Borough Council
of the Borough of Haledon 2-11-1987 by Ord. No. 1-14-87B; amended in its entirety 12-10-1997 by Ord. No.
11-12-97 (Ch. 166 of the 1984 Code). Subsequent
amendments noted where applicable.]
There is hereby established a program for the
separation and collection of newspapers, magazines, high-grade office
paper, junk mail, cardboard, corrugated cardboard, aluminum beverage
containers, glass food and beverage containers, tin bimetal containers,
plastic containers (PET, HDPE), used motor oil, tires, white goods,
ferrous and nonferrous scrap metal, construction/demolition debris,
batteries, leaves, brush, grass, tree stumps/trunks and food waste.
As used in this chapter, the following terms
shall have the meanings indicated:
Cans made entirely of aluminum commonly used for beverage
or other nontoxic liquids.
A small device for producing an electric current for flashlights,
toys and games.
The branches of small trees and bushes for chipping purposes,
limited to branches with a maximum thickness of three inches. Christmas
trees without plastic covers can be included as brush.
Any nonresidential building or establishment, including but
not limited to those used for retail, wholesale, offices, professional
services, shipping and receiving areas and cafeterias.
A thin stiff pasteboard used to make boxes.
All public or private business establishments, including
but not limited to manufacturing, processing, retailing and/or service
establishments.
Events that are sponsored by public or private agencies that
include but are not limited to fairs, bazaars, socials, picnics and
organized sporting events.
Recyclable components of the construction/demolition debris
waste stream, including but not limited to concrete, brick, block,
asphalt, asphalt-based roofing, wood, metal and tree stumps/trunks.
Additional recyclable components of the construction and demolition
debris waste stream will be included as markets are found, such as
window glass, stone, contaminated and uncontaminated soil, nonchemically
treated wood waste, etc.
A type of paper in which a portion has been made to have
a wavy surface (alternating ridges and grooves) and is placed between
two flat surfaces for strength and which is commonly used to form
cartons.
All mandated recycling materials which are to be source-separated
for recycling, namely newspapers, magazines, high-grade office paper,
mixed paper, junk mail, unsoiled scrap paper, corrugated cardboard,
cardboard, glass food and beverage containers, tin or steel food or
beverage containers, plastic containers (PET/HDPE), polyboard, white
goods (stoves, etc.), used motor oil, tires, ferrous and nonferrous
scrap metal, car and household batteries, construction/demolition
debris, batteries, leaves, grass, brush, tree stumps/trunks, branches,
fat, bones, grease and other food wastes.
Scrap metals other than household appliances, including but
not limited to steel, cast iron, aluminum, brass, copper or lead.
Food waste generated by restaurants, taverns, social clubs,
luncheonettes or all food handling establishments. This includes fat,
bones and cooking grease.
Bottles and jars made of silica, soda ash and limestone,
being transparent or translucent and breakable. Specifically excluded
are glass products such as window pane glass, light bulbs, mirrors,
fluorescent bulbs, ceramics, Pyrex, dinner plates and drinking glasses.
Remains as residue on the surface as a result of mowing or
cutting grass.
A licensed person, firm, corporation or association to collect, transport and dispose of recyclable materials not serviced by the municipality. Documentation of tonnage of materials recycled and the market where deposited report shall be submitted in accordance with § 298-7.
Papers generally used in offices that are of high quality
and do not have a glossy finish, including but not limited to white
computer, white letterhead, white ledger and photocopy paper.
An established organization or foundation dedicated to public
service or culture, including but not limited to religious, educational,
health care and governmental establishments and any other nonprofit
organizations.
Advertisements, flyers, brochures, inserts, glossy colored
newspaper or other type of printed matter received through the postal
system.
Materials that are formed from trees and bushes referred
to as "fallen leaves" suitable for composting.
Magazines of soft cover only. Books with hard covers are
excluded. However, if the hard covers are removed And the books tied
or placed in a brown paper bag, they will be accepted.
Office paper not of high quality includes colored stock,
glossy finish or second grade from other sources.
Any properties having seven or more dwelling units per structure.
Paper of the type commonly referred to as "newsprint" and
distributed at stated intervals, usually daily or weekly, having printed
news and opinions and containing advertisements and other printed
materials of public interest.
All individuals, partnerships, corporations, institutions
owners, tenants, occupants, associations or organizations residing,
owning or operating, managing, leasing or occupying any premises or
businesses, commercial or industrial, within the municipal boundaries
of the Borough of Haledon, Passaic County, New Jersey.
Materials of organic compounds synthesized from hydrocarbon
proteins, cellulose, capable of being molded into various shapes.
Containers with logo PETE No. 1 and HDPE No. 2 with "heads" only accepted.
Cardboard containers from milk, juice, frozen foods and ice
cream can only be accepted at the Recycling Center and shall not be
placed for curbside collection.
Any process by which materials that would otherwise become
solid waste are collected, separated or processed and returned to
the economic mainstream in the form of raw materials or products.
Any person who leases and/or occupies dwellings within the
municipality, including those in multifamily dwellings and/or single-family
developments.
Any occupied single-family or multifamily dwellings having
up to three dwelling units per structure for which the municipality
provides municipal solid waste collection services.
Any nonresidential building or establishment, including but
not limited to those used for providing food-related and dining services.
Private, semiprivate or public organizations, including those
which may provide dining service and beverages to members or nonmembers.
Includes all garbage and rubbish normally placed at curbside
by residents and commercial occupants of the Borough of Haledon for
scheduled collections.
Recyclable materials separated at the point of origin for
the purpose of collection, disposition and recycling.
Rubber-based scrap tires that encase the outer part of the
wheels on a car, truck, etc.
Consisting of containers made exclusively of steel or tin,
used to store food or beverages or any other solid or semisolid materials.
Oil that has been removed from any motorized engine.
Apparatus used in a vehicle to store and provide electricity.
Any used refrigerator, hot-water heater, washing machine,
dryer, dishwasher, sink, bathtub, commode, air conditioner, freezer
and microwave oven.
A.Â
On and after the date of final approval of this chapter, it shall be mandatory for all residential, commercial, industrial and institutional establishments of the Borough of Haledon to source-separate designated recycling materials from all other solid waste as in § 298-1 and shall segregate for curbside collection as per the collection schedule in § 298-5 or deposit recyclables at the Recycling Center at 510 Belmont Avenue. Deposits shall be made only on the hours posted and prepared according to specifications. No deposits are permitted on Sundays and holidays or when closed. Owners of real estate in the Borough of Haledon shall be responsible for compliance by their tenants. This shall be done in the manner described in this chapter. Containers shall not be placed at curbside prior to 6:00 p.m. on the day prior to collection and shall be removed from curbside by 8:00 p.m. on the day of collection.
B.Â
Residential developments shall be responsible for establishing a recycling program for the collection of designated recycling materials listed in § 298-1. These materials are to be stored for collection by the municipality or a private recycling vendor or deposited at the municipal recycling depot. If not serviced by the municipality, documentation of tonnage of materials recycled and the market where deposited is to be submitted in accordance with § 298-7.
C.Â
Multifamily. Any owner, landlord, manager or agent of a multifamily housing property with seven or more units per dwelling must source-separate all designated recycling material as listed in § 298-1. The collection system shall include suitable containers for collecting and sorting the recyclable materials, provide easily accessible locations for the containers, and subject to approval by the Superintendent of Public Works, the Housing Maintenance Officer and/or Board of Health. Written instructions must be made available to the occupants concerning the use and availability of the collection system. Documentation of tonnage and market where deposited must be submitted in accordance with § 298-7.
D.Â
Commercial establishments and institutions.
(1)Â
Commercial establishments and institutions such as restaurants, taverns, social clubs, hospitals or nursing homes must separate designated recyclable materials as listed in § 298-1. Designated recyclable materials may be deposited at the Recycling Center if prepared according to specifications and if they meet certain quantity limitations. Otherwise, each establishment shall be responsible for establishing programs for the collection, transportation and marketing of designated recyclable materials. Documentation of tonnage of materials and the market where deposited is to be submitted in accordance with § 298-7.
(2)Â
Cooking grease, fat or oil used in commercial food-handling
establishments for the preparation of food is a recyclable product
and cannot be discarded in garbage containers or in the sanitary sewer
system of the Borough of Haledon. It must be collected and the market
and tonnage be made available to the Office of Recycling.
E.Â
Community activities such as public, private agencies or individuals that include but are not limited to fairs, bazaars, flea markets, socials, parades, picnics and/or organized sporting events must separate designated recyclable materials as specified in § 298-1. Source-separated recyclable materials may be deposited at the Recycling Center on days and hours posted and prepared to specifications and meet certain quantity limitations. Otherwise, if recyclable materials are collected by a private collector or hauler, documentation of recyclable materials, tonnage and the market where deposited is to be submitted in accordance with § 298-7.
A.Â
The Planning Board shall consider recycling as a requirement
of any application before the Board.

B.Â
It shall be mandatory and a condition precedent to
the issuance of any temporary or permanent certificate of occupancy
or building permit for the owner of such property to recycle all construction
and/or demolition debris by a private hauler and submit tonnage and
marketplace to the Building Department officials in the Borough of
Haledon or the Office of Recycling.
C.Â
Written documentation of the tonnage of materials
recycled under this chapter shall be made by accurate weight slips
and/or in such form as required by the Recycling Coordinator as will
satisfy state requirements for the Borough eligibility for state tonnage
grants.
D.Â
All commercial/industrial sectors are required to
implement an audit waste survey plan.

E.Â
All sectors will be notified at least every six months
of the provisions of this chapter and the various responsibilities
of each sector for recycling. This may include public places, community
calendars and/or newspaper advertising. It is the responsibility of
the owner of all properties in the Borough of Haledon to notify tenants
of the rules and regulations of this chapter.
A.Â
First Wednesday of the month: Newspapers shall be
placed in brown paper bags or cross-tied with twine or string. Papers
shall not be bound with wire, tape or placed in plastic bags or cardboard
boxes. Bundles shall not exceed 35 pounds nor be larger than 12 inches
high. This subsection also includes magazines, high-grade office paper,
junk mail, mixed paper, colored paper, envelopes, NCR paper, catalogs,
colored newspaper advertisements and nonmetallic gift wrapping paper.
B.Â
Second Wednesday of the month: cardboard and corrugated
cardboard. Cardboard such as cereal, rice, macaroni boxes and dried
food product boxes with wax liners removed; rolls from empty paper
towels and toothpaste shall be flattened and placed in brown paper
bags. Corrugated cardboard shall be flattened and tied and must be
free of wood, plastic, wire or styrofoam. Do not include contaminated
cardboard such as pizza boxes or other cardboard that has been soiled
with oil, grease or food residue.
C.Â
Third Wednesday of the month (east side of town, households
who have solid waste collections Mondays and Thursdays): glass food
and beverage containers, aluminum beverage containers, steel, tin
food and beverage containers and plastic containers (commingled).
All containers shall be rinsed clean and placed in a strong plastic
or metal container, holding not more than 32 gallons, whose contents
can be easily dumped into a recycling vehicle and shall not exceed
35 pounds. Placing recyclables at curbside in cardboard boxes, paper
bags or plastic bags will not be accepted. Window glass, light bulbs,
fluorescent bulbs, dinner plates, china, drinking glasses, crystal
ceramics, mirrors, flowerpots, aluminum foil pans, TV dinner trays
and aluminum siding are excluded from being recycled. Paint, gas,
turpentine cans or other containers that contain hazardous materials
are specifically excluded at present for recycling.

D.Â
Fourth Wednesday of the month: (west side of town
for households who have solid waste collections on Tuesdays and Fridays):
glass food and beverage containers, aluminum beverage containers,
bimetal food and beverage containers and plastic containers (commingled).
All containers shall be rinsed clean and placed in a strong plastic
or metal container, holding not more than 32 gallons, whose contents
can be easily dumped into a recycling vehicle and shall not exceed

E.Â
Leaves shall be raked, blown or transported to the
curbside and placed in appropriate piles or in biodegradable paper
bags not bound with wire or tape, placed at the curbside between October
and December; the schedule will be made available for collection by
the Department of Public Works. Leaves shall be free of tree branches
or stones.
F.Â
White goods as defined herein shall mean stoves, refrigerators,
washing machines, dryers, hot-water heaters, microwave ovens, dishwashers,
air conditioners, sinks, bathtubs and commodes and shall not be placed
at curbside until prior arrangements are made with the municipality's
collector and payment of any required fee.
G.Â
Brush, branches and hedge clippings shall be placed
at curbside once a week starting when schedule is available in the
beginning of the year, and collection ends with the start of the leaf
collection time. Brush and branches are limited to three tied bundles
per collection per dwelling, cut to three feet in length. Branches
shall not to be larger than three inches in diameter and not weigh
more than 35 pounds. Place clippings in biodegradable bags.
H.Â
Rugs/carpeting are limited to three bundles, cut into
four-foot lengths and each bundle not to exceed 35 pounds.
I.Â
Construction/demolition material is not accepted at
curbside or at the Recycling Center. The contractor shall be responsible
for removal of material.
J.Â
Not to be placed at curbside collection are tires,
batteries, scrap metal, includes metal pots and pans, and polyboard.
These items are only accepted at the Recycling Center. At the center
no recyclables are commingled. Containers are provided for each recyclable
item. No full or partially filled paint cans or thinners, antifreeze
or other liquid solvents are accepted at curbside or at the Recycling
Center.
A.Â
Grass clippings and lawn waste shall not be placed
into the solid waste flow nor shall it be placed at curbside for pickup,
nor shall it be brought to the Recycling Center.
B.Â
This material shall remain on the lawn (cut and leave
it), used as mulching or placed in a backyard composting bin.
C.Â
Lawn contractors who maintain lawns in Haledon cannot
leave grass clippings at curbside or at the Recycling Center.
A.Â
All commercial, institutional, apartments, multi-
or single-family developments which are not serviced by the municipal
recycling collection system must submit recycling documentation on
a quarterly basis to the Municipal Recycling Coordinator. This shall
include haulers or private collectors. Due dates for report periods
are as follows:

B.Â
The Municipal Recycling Coordinator will compile all
recycling documentation and report to the County Recycling Coordinator
on a quarterly basis by the 15th of the months stated above as due
dates.
D.Â
Documentation indicating compliance with municipal
recycling certification requirements will be forwarded to the Passaic
County Coordinator by April 15 of each year for information on the
previous calendar year's activities for certification purposes.
E.Â
All of the aforementioned provisions may from time
to time be modified by the Municipal Recycling Coordinator to the
extent that procedures are developed to improve the recycling program.
Recycling materials placed at the curb or recycling depot are the property of the Borough of Haledon or its authorized agent. It is a violation of this chapter for any person unauthorized by the Borough of Haledon to collect or pick up or to cause to be collected or picked up any recyclable. Any and each such collection in violation hereof shall constitute a separate and distinct offense punishable as hereafter provided in § 298-12.
Any person who is an owner, lessee or occupant may donate or sell recyclable materials to any person, partnership or corporation (whether operating for profit or not for profit) as long as the recycling individual or company submits documentation to the Recycling Coordinator as described in § 298-7.
The Municipal Recycling Enforcement Officer,
Police Department, Superintendent of Public Works, officials of the
Department of Health, Municipal Housing Maintenance Enforcer or their
designated agent is/are hereby authorized and directed to enforce
this chapter, including inspections and penalties for noncompliance.
Included will be penalties for noncompliance with rules and regulations
for deposit of recyclables in the depot. Enforcement agent shall be
extended to include the County Health Department or its designee.
A.Â
It shall be unlawful to combine designated unsoiled
recyclable materials with other solid waste. Failure to source-separate
designated materials for recycling is a violation of this chapter.
B.Â
It shall be unlawful for solid waste collectors to
collect solid waste that contains visible signs of designated recyclable
materials. It is unlawful for solid waste collectors to remove for
disposal those bags or containers of solid waste/recyclables which
visibly display a warning notice sticker or some other device indicating
that the load of solid waste contains designated recyclable materials
and therefore should not be removed for disposal.
C.Â
It shall be the responsibility of the nonrecycler
whose solid waste was not removed because it contained recyclables
to properly segregate the uncollected waste for proper recycling.
Allowing such unseparated refuse to accumulate at curbside will be
considered a violation of this chapter and the local sanitary code.
A.Â
Any person, firm or corporation who violates any of
the provisions of this chapter shall, upon conviction, be sentenced
to pay a fine of not less than $25 and not to exceed $1,000.
B.Â
Any unlawful dumping of recyclable or solid waste
materials at the Recycling Center or anywhere within the jurisdiction
of the Borough shall be punishable by a fine not less than $100 and
not to exceed $1,000.
C.Â
Each and every day that said violations continue shall
be considered a separate offense.
A.Â
The enforcement agent or his/her designated agent
shall be responsible for the inspection of solid waste and/or recyclable
materials in all sectors in order to determine any noncompliance with
this chapter. These inspections will be made on a random basis, at
a frequency of at least once per month per collection route.
B.Â
Inspections will consist of the bumping and opening
of refuse containers or bags to detect by sound or visible presence
of any recyclable materials.
The Borough Council may, in accordance with
the procedures of N.J.S.A. 40A:11-1 et seq., enter into agreements
granting a franchise or license to qualified persons, partnerships,
corporations or organizations to authorize them to collect all newspapers,
magazines, corrugated cardboard, cardboard, glass, aluminum or bimetal
food and beverage containers or any other designated recyclable materials
at curbside or at the depot. The Borough Council may, in accordance
with the procedures of N.J.S.A. 40A:11-1 et seq., enter into agreement
to have all the above recyclable materials collected at curbside or
at the depot. The Borough Council may, if it elects, use Borough personnel
to collect all recyclable materials at curbside or at the depot and
sell all recyclable materials pursuant to N.J.S.A. 40A:12-1 et seq.
The Municipal Recycling Coordinator will compile all recycling documentation
and report to the County Recycling Coordinator on a quarterly basis.
