It shall be unlawful for any person to:
A. 
Engage in the operation of one or more machines or devices offered for use which, upon insertion of a coin, coins or token or by other means, dispense food or beverage, either in bulk or package, without the necessity of replenishing the device between each vending operation, without first having applied for and procured a permit from the Board of Health of the Borough of Haledon or without complying with the provisions of Chapter 430, Food-Handling Establishments. A permit shall be required of each occupant of a business or other establishment in the Borough in which such a machine or device is located and shall also be required of every person owning or operating such a machine or device in any location in the Borough of Haledon.
B. 
Maintain or permit to be maintained on or at any location in this municipality one or more machines or devices offered for use which, upon insertion of a coin, coins or token or by other means, dispense servings of food or beverage, either in bulk or package, without the necessity of replenishing the device between each vending operation, without first having applied for and procured a license for each such machine or device from the Board of Health of the Borough of Haledon or without complying with the provisions of Chapter 430, Food-Handling Establishments.
Application for an issuance of permit and license shall be made in compliance with the provisions of Chapter 430, Food-Handling Establishments, as adopted by the Board of Health of the Borough of Haledon. Such permits and licenses are not transferable.

The fees for permits and licenses, which are hereby established for the regulation and control of the said vending machines, are to be paid annually to this municipality for a period of one year or any part thereof and are hereby fixed as follows:
A. 
Permit fee: $25 per year.
B. 
License fee: $15 per machine per year.

The permittee to whom a permit has been granted shall affix the same in a conspicuous place in the premises where the machine or device is operated so that the same shall be easily and quickly identified. A licensee to whom a license or licenses have been issued for each machine or device shall affix to the machine or device a license identification number which shall be provided by the Board of Health for that purpose. It shall be unlawful to operate, maintain or permit any machine or device in the Borough of Haledon without the conspicuous display of the permit and the license identification number required herein.
Permits and licenses issued under authority of this article may be suspended, revoked or reinstated by the Board of Health of the Borough of Haledon pursuant to the provisions of Chapter 430, Food-Handling Establishments.

Any person who violates any provision of this article shall, upon conviction thereof, be liable to a penalty of not more than $500 or imprisonment for not more than 90 days, or both, for each violation. Each day a particular violation continues shall constitute a separate violation.
