As used in this article, the following terms shall have the meanings indicated:
FOOD
Includes any drink or beverage intended for human consumption.
PERSON
Includes any individual, firm, corporation, society, partnership, unincorporated association or an association engaged in the business or employed in the business of preparing and processing food intended for human consumption, be it immediate on- or off-premises consumption.
No person shall engage in or be employed in the business of or service of preparing and processing food intended for human consumption without first having obtained a food handler's certificate, upon written application therefor, from the Board of Health of the Borough of Haledon, New Jersey, except as is expressly limited by § 430-7 of this article.
The food handlers certificate required by § 430-5 of this article shall not be issued or granted to any person unless the person seeking such food handler's certificate shall have first completed a course of instruction, generally, in health education, sanitation, personal hygiene, food poisoning, dishwashing procedures and other matters related to safe food handling. The course of instruction shall be under the supervision or direction of the Health Officer of the Borough of Haledon, New Jersey. If said course of instruction is completed elsewhere, the Health Officer shall determine if such course of instruction meets the intent of this section. The burden of proving that such course of instruction was obtained and satisfactorily completed shall be with the applicant. This requirement does not replace N.J.A.C. 8:24-2.1.
No person, as is herein defined, shall engage in or be employed in the business of preparing or processing food intended for human consumption for a period exceeding 30 days without applying for the food handler's certificate and also fully complying with all the terms as are prescribed in this article.
No person to whom a food handler's certificate is issued or granted shall give, loan, transfer or permit the same to be used by any other person for any purpose whatsoever.
A. 
The food handler's certificate, when granted, shall be valid until the same is suspended or revoked.
B. 
For good cause shown and on written notice to any person holding a food handler's certificate, the Board of Health of the Borough of Haledon, New Jersey, or its designee, expressly reserves the right to suspend or revoke any food handler's certificate issued or granted pursuant to this article.
A. 
All employers engaged in the business or service of preparing and processing food intended for human consumption, be it for immediate on- or off-premises consumption, shall at all times keep and maintain accurate records of the name and address of each employee, date of employment, the date of the issuance of said food handler's certificate and the number thereof, which record shall be available at all times for inspection by the Board of Health of the Borough of Haledon, New Jersey, or any of its accredited agents or representatives.
B. 
Except as is expressly limited in § 430-7 herein intended for new employees, no employer shall employ any person in the preparation or processing of food intended for human consumption unless the person so employed shall have a food handler's certificate as is herein defined.
Any person who violates any provision or order promulgated under this article shall, upon conviction thereof, be liable to a penalty of not less than $100 nor more than $500 or be imprisoned in the county jail for a period not exceeding 90 days, or both for each violation. Each day a particular violation continues shall constitute a separate offense.
