Employees, elected officials, appointed officials and officers, including members of any board or commission, and board and commission employees, and members of the Fire Department and first aid, ambulance and rescue services of the Borough of Hamburg, and any other volunteer organization established under the laws of the Borough of Hamburg, shall comply with the provisions of this chapter.
Any person holding any position, office or employment mentioned above, charged with any of the offenses mentioned hereafter, whether the charge be made by complaint, summons, accusation information or indictment, shall notify the Municipal Clerk, in writing, within 48 hours of receipt of the charge. The offenses are petty disorderly person, disorderly person, criminal, or similar offenses against the laws of any other state or any federal criminal law.
Failure to notify as set forth above shall subject the violator to such disciplinary action by the Mayor and Council as provided by law, including, but not limited to, suspension, demotion or termination.
Upon conviction, entry of a guilty plea or entry into a pretrial intervention program by the violator, the Mayor and Council may take disciplinary action in accordance with law, including, but not limited to, suspension, demotion or termination. Pending Mayor and Council action, the violator shall be immediately suspended, in accordance with law, if the conviction, entry of a guilty plea or entry into a pretrial intervention program was based on a violation of a state crime of the first, second or third degree; a similar crime under the laws of any other state; or any federal criminal law.
