The hours during which use of the skateboard park is permitted shall be as follows:
A. 
On any day during the school year that Hamilton Township Schools are open:
(1) 
Monday through Friday, 2:30 p.m. to 5:00 p.m., Eastern standard time.
(2) 
Monday through Friday, 2:30 p.m. to 7:00 p.m., daylight saving time.
B. 
On any day during the school year that Hamilton Township Schools are closed for holidays and/or summer vacation:
(1) 
Monday through Friday, 10:00 a.m. to 5:00 p.m., Eastern standard time.
(2) 
Monday through Friday, 10:00 a.m. to 7:00 p.m., daylight saving time.
C. 
Saturday and Sunday only year round:
(1) 
Ten o'clock a.m. to 5:00 p.m., Eastern standard time.
(2) 
Ten o'clock a.m. to 7:00 p.m., daylight saving time.
D. 
The Township reserves the right to close the park at an earlier hour for any reason within the sole discretion of the Township.
The skateboard park will be unsupervised, and any and all individuals using said park understand and agree that they will proceed at their own risk.
Any and all persons utilizing the skateboard park shall be required to wear authorized and approved safety equipment. This includes, at a minimum, a safety helmet with safety strap, elbow pads, and kneepads. Those using skateboards shall also be required to wear shoes. Using a skateboard with bare feet, sandals or flip flops is prohibited. Anyone not wearing safety equipment as set forth in this section of this article will be in violation of said article and shall be subject to any and all fines and penalties set forth in the penalty section[1] of this article and removal from the facility for the duration of the day on which the offense occurs.

The skateboard park shall be used for skateboard and inline skating only. No bicycling, unicycles, scooters, ball playing or any other kinds of activity shall be permitted at said skateboard park.
Any child under 11 years of age using the skateboard park must be accompanied by an adult. A nonskater is prohibited from entering or being located at the skateboard facility unless said individual is accompanying an underage child.
The use of the skateboard park shall only be allowed when weather permits. Any type of skating or skateboarding when there is rain or snow accumulated on the ground is strictly prohibited, and skating or skateboarding shall be prohibited when the skateboard park surface is wet or icy.
No food or drink, glass container, alcoholic beverage[1] or other food and/or beverage of any nature shall be permitted at the skateboard park.

The rules and regulations attached hereto as Exhibit A[1] are hereby approved and adopted. The Township Committee of the Township of Hamilton reserves the right to establish by resolution additional rules and regulations for the use and control of the skateboard park. Any such rules and regulations, along with a copy of this article, shall be posted at the skateboard park and shall be binding upon any individual using said skateboard park.

Any person who violates any provision of this article shall be subject to a penalty for each offense of a fine of not more than $1,000 or imprisonment for not more than 90 days or community service for not more than 90 days, or any combination of the same in the discretion of the Municipal Court Judge. In addition, any person who is alleged to have violated this article shall be subject to immediate removal from the skateboard park for the remainder of the day on which said violation occurs.
