The purpose of this article is to set up a procedure for owners of land designated H-B Zone under the Township of Hamilton Zoning Ordinance for the licensing of outdoor sporting events not specifically enumerated under Chapter 203, Land Use and Development.
This article is a licensing ordinance supplemental to all other licensing
ordinances of the Township of Hamilton, and any applicant for a license under
this article shall be required to comply with all other requirements of any
and all other licensing ordinances of the Township of Hamilton in addition
to the requirements of this article.[1]
It shall not be lawful for any person, partnership, corporation, firm,
company, association, society or group, either directly or indirectly, to
conduct any outdoor sporting event in an H-B Zone unless the same is specifically
enumerated as permitted in the H-B Zone, in whole or in part, unless a license
or a permit therefor is first procured and kept in effect at all such times
required by this article or any other law or ordinance of the Township of
Hamilton.
A.
Every person required to procure a license under the
provisions of this article shall submit an application for such license to
the Township Clerk of the Township of Hamilton, City Hall, Mays Landing, New
Jersey, which application shall be accompanied by a full and complete explanation,
along with documents pertinent thereto, of the time, nature and quality of
the event or events to be conducted, along with the full amount of the fees
chargeable for the license applied for.

The statement that shall accompany the application shall
be in writing and shall contain the following:
(1)
Previous license history of the applicant and whether
any previous revocation or suspension has occurred and the reasons therefor.
(2)
Statement that the applicant is not indebted or obligated
to the Township of Hamilton, except for current taxes.
(3)
Description of the premises at which the event is to
be carried out and name and address of the owner of said premises.
(4)
Such other facts relative to the general history of the
applicant and the complete nature of the event to be conducted.
All licenses shall be good and in full force and effect during the period
of time specifically enumerated on said license, and the activity licensed
shall be permitted only during those times, and the license shall not be renewable
except by the submission of a de novo application.
The licensing fee to be paid shall be $1,000. The fee must accompany
the application.
The application for a license shall be processed within 30 days of receipt
and shall be issued when and if the Township Committee, in its discretion,
is agreed that the conduct requested by the applicant will not be detrimental
to other ordinances of the township or the laws of the State of New Jersey,
and is in the public welfare.
The Township Committee may issue said license subject to certain terms
and conditions that it sets and, further, may revoke said license if any of
the conditions necessary for the issuance are not complied with or if any
condition previously met ceases to be complied with.
The Township Inspector shall be designated as the enforcement officer
of this article.
Any person who violates this article, or violates any condition upon
which he has been granted a license, will be fined, if found guilty, not less
than $1,000 nor more than $10,000. Each violation shall be considered a separate
offense.
The application of this article is specifically confined to the H-B Zone as it is designated in Chapter 203, Land Use and Development. All other licensing ordinances of the Township of Hamilton that may be similarly applicable in the H-B Zone remain in full force and effect, it being the intention of the Township Committee of the Township of Hamilton to apply the terms and conditions of this article in addition to any other licensing ordinances above referred to.
