In accordance with Subdivision B of Article I of Chapter 3 of
Title 26 of the Revised Statutes of the State of New Jersey, as amended,
which subdivision is expressly adopted, there is hereby established
and constituted in and for the Township of Hillsborough a Board of
Health consisting of seven members and two alternate members identified
as Alternate 1 and Alternate 2 to be appointed by the Mayor and confirmed
by the Township Committee for the terms hereinafter provided. An alternate
member may participate in discussions of the proceedings but may not
vote except in the absence or disqualification of a regular member.
A vote shall not be delayed in order that a regular member may vote
instead of an alternate member. In the event that a choice must be
made as to which alternate member is to vote, Alternate 1 shall vote
first.

Members of the Board of Health as herein constituted shall be
appointed for a term of four years; provided, however, that the terms
of office of the members first appointed by the Mayor shall be so
arranged that not more than two terms shall expire in any one year.
The terms of the alternate members of the Board of Health shall be
for two years, except that the terms of the alternate members first
appointed shall be two years for Alternate 1 and one year for Alternate
2, so that the term of not more than one alternate member shall expire
in any one year. Each member of the Board of Health shall be a resident
of the Township of Hillsborough.
Said Board of Health shall organize at a meeting
to be held within 30 days of the appointment of members thereto and
thereafter in January of each year and shall meet during the year
in accordance with its own rules, but such subsequent meetings shall
be held at least once in each month.
Any vacancy on the Board of Health shall be
filled by appointment by the Mayor and confirmation by the Township
Committee for the unexpired term resulting from said vacancy.
The Board of Health as herein constituted may
appoint a Secretary for the Board of Health for a term of one year.
Said Secretary need not be a member of the Board of Health, in which
event he shall have no voting rights or other legislative authority
on the Board of Health.
A.
The Board may employ such personnel as it may deem
necessary, of the classes and grades provided for by law, to carry
in effect the powers vested in it. It shall fix the term, duties and
compensation of every appointee. No person shall be appointed as hereinabove
provided who is not the holder of a proper license as such where a
license is required by law.
B.
The appointees of the Board shall hold their offices
during the term for which they are severally appointed and shall not
be removed except for cause and after an opportunity has been given
them for a hearing.
A.
The Board shall have all the powers and duties granted
to local health boards by the statutory laws of the state and may
adopt and amend ordinances and may make rules and regulations for
its government and that of its officers and employees not inconsistent
with law and the State Sanitary Code.[1]

B.
All ordinances of the Board of Health of the Township
of Hillsborough concerning public health now in existence shall remain
in full force and effect until and unless amended or repealed by the
Board, except insofar as they are inconsistent with the provisions
hereof.
All appointees of the present Board of Health
of the Township of Hillsborough shall continue to hold their respective
offices under the Board of Health set up under this chapter until
their respective terms of office shall expire.
