No person under the age of 18 years shall be permitted on any public place, public street or public property in the Township of Hillsborough between the hours of 10:00 p.m. and 6:00 a.m., prevailing time, of each and every day during the period from October 28 to November 1, inclusive, of each year, unless such person is in attendance at a program or function sponsored by the municipality, a church or school. This section shall not apply to persons under the age of 18 years while they are returning home from a place of employment, school, fraternal or religious meeting or going to and from a doctor's or dentist's office, where treatment has been rendered or is to be rendered, or to persons under the age of 18 years who are accompanied by a parent or guardian over the age of 21 years.
Any person who is a parent, guardian or standing in loco parentis of any such person under the age of 18 years, who permits, consents to or approves or allows any person under the age of 18 years to violate the provisions of this article or any portion thereof, shall likewise be guilty of a violation of this article, except in case of emergency.
Every member of the police force, while on duty, is hereby authorized to detain any such minor willfully violating the provisions of this article until the parent or guardian of the child shall take him or her into custody, but such officer shall immediately, upon taking custody of the child, communicate with the parent or guardian.
Any person who shall violate this article shall be subject, upon conviction therefor, to a fine not exceeding $250.
Notwithstanding any other provisions of this article, the Township of Hillsborough hereby reserves the right to waive the provisions of this article to the extent of approving attendance at programs or functions sponsored by organizations who apply to the Township for such waiver. Any waiving of said provisions shall not be considered a precedent which would affect subsequent enforcement or nonenforcement of the provisions of this article. In the event the Township of Hillsborough does waive any provision, it shall be done by resolution at a regular or special meeting of the Township Committee.
