The construction of any driveway servicing a structure or the construction of a private road is hereby prohibited unless a permit therefor has first been obtained from the Clerk of the Borough.

A. 
Application for said permit shall be made to the Clerk upon such form as shall be provided thereby for such purpose. At the time of the application, the applicant shall pay to the Clerk, for the use of the Borough of Kinnelon, a fee of $5, which shall not be refundable.
B. 
Upon the receipt of such application, the Clerk shall submit the same to the agent of the Borough of Kinnelon, duly constituted and appointed for such purpose by resolution of the governing body, for review and approval in accordance with § 113-3 hereof.
C. 
Upon such approval being indicated to the Clerk, together with a determination by said agent of the Borough of Kinnelon as to the amount, the applicant shall file with the Clerk, in addition to the fee hereinabove prescribed, a cash deposit in such amount or a surety bond of double such amount to guarantee compliance with the terms of the permit, whereupon the Clerk shall issue such permit except as hereinafter provided. Such cash deposit or surety bond shall be refunded to the permittee by the Clerk upon satisfaction duly stated to the Clerk by said agent of the Borough of Kinnelon that the permittee has complied with all of the terms of the permit.
D. 
Whenever any driveway or private road shall be intended to serve a building to be newly constructed, application for the permit herein provided for shall be made in conjunction with the application for a building permit for such building. The Building Official is hereby empowered to withhold the issuance of such building permit unless such driveway connection permit application has first been approved pursuant to this chapter.

A. 
Such permit shall specify the location of said driveway or private road and shall contain such other specifications and conditions as said agent of the Borough of Kinnelon requires affecting drainage and juncture with a municipal road.
B. 
If a driveway is 300 feet or more in length, or is designed in such a manner as, in the judgment of said agent of the Borough, will encumber ingress, egress or access of emergency vehicles to the structure, the driveway shall include a turnaround area for the use of emergency vehicles. Said turnaround area shall be annexed perpendicular to the driveway and shall have a minimum width of 20 feet and shall have a minimum length of 35 feet and shall be located at a distance in the driveway which is not less than 50 feet from the structure and no more than 100 feet from the structure.
It shall be the duty of the permittee to properly guard the construction by erecting suitable barriers, warning signs and lanterns, and such permittee shall be liable for any neglect to safeguard the traveling public.

Any person, firm or corporation violating this chapter shall be subject, upon conviction, to one or more of the following at the discretion of the court: a fine not to exceed $1,000 or imprisonment in the county jail for a term not to exceed 90 days or community service not to exceed 90 days.
