A. 
It shall be unlawful for any person to engage in the business of operating an establishment where body art is performed without first obtaining a license from the Borough of Kinnelon Board of Health to engage in such business in accordance with the provisions hereof.
B. 
An application for an initial license shall be accompanied by a fee in the amount of $200 for tattooing and permanent cosmetics and $100 for body piercing. Any change of ownership shall require a new application and license with payment of fees therefor. All applicants shall submit plans for the establishments to the Borough of Kinnelon Board of Health prior to initiation or construction.
C. 
The renewal license fee for engaging in the business of operating a body art establishment within the Borough of Kinnelon shall be $100 per year for tattooing and permanent cosmetics; and $50 per year for body piercing. All licenses shall expire on the last day of each calendar year. Temporary body art establishments are prohibited within the Borough of Kinnelon.
D. 
Licenses issued pursuant to this chapter shall not be transferable, nor shall they be construed as authorizing the licensee or licensees to carry on the business at any place other than that specified in the license itself.
E. 
License issued pursuant to this chapter may be revoked by the Borough Board of Health for any good or sufficient reason, provided that due notice thereof shall be given to the licensee and a hearing held before the Board of Health, at which time an opportunity shall be afforded the licensee to show cause why the license should not be revoked.
Body art establishments shall comply with the provisions of the New Jersey Administrative Code, Chapter 8, § 27-1 et seq.
