[HISTORY: Adopted by the Board of Health of the Borough of Kinnelon 6-22-1988 by Ord. No. 88-4 (Ch. 100A of the 1972 Code). Amendments noted where applicable.]
No person may spray pesticides, fungicides or herbicides in the Borough of Kinnelon, except on property owned or leased by that person, unless and until the person is duly licensed by the New Jersey Department of Environmental Protection and/or such other appropriate state agency or authority and shall follow applicable rules and regulations of such agency or authority.

The person shall register, fill out an application and pay a license fee of $100 per year to the Board of Health. Such fees shall be used to defray the costs of implementing and administering this chapter and are payable by no later than January 30 of each year.

The person shall notify any and all residents of any spraying which is to occur within 500 feet of the resident's property in advance of such spraying, provided that the resident has registered with the Kinnelon Health Department, in person, or filed a "Request for Notice of Spraying" card prior to February 28, in any calendar year. Public notice that registration is required to ensure notice shall be made by the Health Department annually.
The person shall submit all vehicles and equipment used in the Borough of Kinnelon to inspection and approval by the Kinnelon Health Department at least once prior to each spraying season, without the need for formal notification by the Health Department. However, the Health Department may request additional inspections during the spraying season.
The person shall provide the Kinnelon Health Department with a list of all chemicals used in spraying and the names and CPO numbers and certifications of all applicators.
The person shall fill vehicles or equipment with water only from sources approved by the Health Department, and such filling shall be done in a manner using only procedures approved by the Health Department.
The person shall notify, in person, any resident within 500 feet of spraying prior to actual spraying if the resident could not be contacted by phone prior to the commencement of spraying operations.
Each vehicle used in spraying operations shall have on board a state licensed applicator at all times.

A violation of any of the provisions of this chapter shall subject the person to a fine of not less than $200 or more than $500 for each violation and revocation of the license to conduct spraying operations in this Borough.
