The provisions of Subdivision B of Article 1
of N.J.S.A. 26:3-3 et seq. are hereby adopted in the Township of Little
Egg Harbor.

The local Board of Health of the Township of
Little Egg Harbor shall be composed of seven members and two alternates.
The alternate members shall be designated as Alternate No. 1 and Alternate
No. 2. Upon consent of the prospective appointee, the governing body
of the Township may appoint a school nurse or a municipal physician
to the local board notwithstanding that the nurse or physician is
not a resident of the Township of Little Egg Harbor.
Regular and alternate members of the local Board
of Health shall be appointed by the Mayor, subject to the confirmation
by affirmative vote of a majority of the members of the governing
body in attendance at a regular meeting.
A.
Three of the members first appointed and confirmed shall serve for terms of three years, and two of the members first appointed and confirmed shall serve for terms of two years. Upon the expiration of the term of each of the members first appointed, all subsequent appointments shall be for terms of three years. Any appointment made to fill any vacancy occurring other than by reason of the expiration of the term of a member shall be for the period of the unexpired term only and shall be made in the same manner and by the same method as provided in § 55-3 hereof for the making of the original appointments to said Board.
B.
The terms of alternate members shall be for two years,
except that the terms of the alternate members first appointed shall
be for two years for Alternate No. 1 and one year for Alternate No.
2, so that the term of not more than one alternate member shall expire
in any one year. A vacancy occurring otherwise than by expiration
of term shall be filled by the governing body for the unexpired term
only.

A.
The Board
of Health, upon appointment and confirmation of all of its members,
shall, within two weeks from the date thereof, hold an organizational
meeting at which it shall fix a place, day and hour for the regular
meeting of the Board to conduct its general business, notice of which
shall be published in at least one newspaper circulating in the Township
of Little Egg Harbor. The Board shall hold at least one regular meeting
each quarter of the year and such special meetings as may be called
from time to time by the Chairman of the Board of Health or by four
members of said Board in accordance with such rules and regulations
as said Board may adopt.
B.
After the
qualification of the members of said Board, they shall each year select
one of their members who shall be the Secretary of the Board.
C.
An alternate
member may participate in discussions of the proceedings but may not
vote except in the absence or disqualification of a regular member.
A vote shall not be delayed in order that a regular member may vote
instead of an alternate member. In the event that a choice must be
made as to which alternate member is to vote, Alternate No. 1 shall
vote first.
D.
An alternate
member shall not be permitted to act on any matter in which he or
she has, either directly or indirectly, any personal or financial
interest. An alternate member may, after public hearing if he or she
requests one, be removed by the governing body for cause.
The members of the Board of Health shall receive
no salary or compensation for their services.
Upon appointment and confirmation of the members
of the new Board, the Township Clerk shall notify each appointee of
his or her appointment and shall properly induct him into office.
The tenure of the present Board of Health shall cease at the time
of, and simultaneously with, the organization and qualification of
the new Board as provided for herein. Upon the induction of the new
members into office and after organization thereof, the new Board
shall immediately assume all of the duties, obligations and responsibilities
of the local Board of Health.
