There is hereby created the position of Municipal Clerk for the Township of Little Egg Harbor pursuant to N.J.S.A. 40A:9-133.
A. 
The Municipal Clerk shall act as the secretary to the governing body and custodian of municipal records. The Municipal Clerk shall plan and coordinate office activities in accordance with state/local laws, rules, regulations and policies, and perform such functions as may be required by N.J.S.A. 40A:9-133. The Municipal Clerk shall also perform other related work as required.
B. 
To be appointed to the position of Municipal Clerk, an individual must possess a municipal clerk certificate as provided for by N.J.S.A. 40A:9-133.2.
Within 90 days of the occurrence of a vacancy in the office of Municipal Clerk by reason of the departure of the Registered Municipal Clerk, the governing body of the Township of Little Egg Harbor may appoint a person who does not hold a registered municipal clerk certificate to act as Acting Municipal Clerk for a period not to exceed one year, commencing on the date of the vacancy. Any person so appointed may, with the approval of the Director of the Division of Local Government Services in the Department of Community Affairs, be reappointed as Acting Municipal Clerk for a maximum of two subsequent one-year terms following the termination of the temporary appointment. No local unit shall fill the position of Acting Municipal Clerk for more than three consecutive years. Time served as Acting Municipal Clerk may be credited toward the experience authorized as a substitute for the college education requirement pursuant to N.J.S.A. 40A:9-133.2. Time served as Acting Municipal Clerk may not be credited as time served as Municipal Clerk for the purposes of acquiring tenure pursuant to N.J.S.A. 40A:9-133.7.
The Municipal Clerk shall be appointed by the Township Committee and shall serve for a term of three years, commencing on January 1 of the year of appointment and ending on December 31 of the third year, or until a successor shall be appointed and qualified. A vacancy in the office of Municipal Clerk, other than due to expiration of term, shall be filled by appointment for the unexpired term.
