Subarticle A. Parking Places Open to the Public
[Added by Ord. No. 21-1981]
The purpose of this subarticle is to prohibit parking in areas designated for use as handicapped parking, except by persons who have been issued special identification cards by the Director of the Division of Motor Vehicles or a temporary handicapped placard issued by the Chief of Police, on private properties that are open to the public or to which the public is invited. No other person shall be permitted to park in such spaces.
This subarticle is enacted in accordance with N.J.S.A. 40:48-2.46, which does confer upon the Township of Livingston the right to establish handicapped parking spaces in order to preserve and safeguard the public health, safety, morals and welfare.

A. 
The following areas shall be designated as handicapped parking spaces for use by persons who have been issued special identification cards by the Director of the Division of Motor Vehicles or a temporary handicapped placard issued by the Chief of Police in Livingston. These spaces shall be marked by signs indicating these spaces are handicapped parking spaces and, except in the case of no-parking zones, notice shall be given to the public by highway markings indicating these spaces are handicapped parking spaces. Such signs and markings shall be in conformance with the current Uniform Traffic Control Devices Manual and shall state applicable penalties. No other use shall be permitted in these parking spaces.
B. 
The owners of the properties set forth below shall be responsible for the installation and maintenance of the signs and pavement markings, and such installation and maintenance shall be in accord with the current Uniform Traffic Control Devices Manual. The Police Department shall be responsible for periodic inspection of signs and markings in accord with the current Uniform Traffic Control Devices Manual.

Burnet Hill Elementary School
2 spaces near the side entrance, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 8 feet in width with a five-foot aisle in between leading to the handicapped ramp.
Calabria Pizzeria, 588 South Livingston Avenue
1 space located in the corner of the parking lot closest to South Livingston Avenue, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width and a minimum of 20 feet in length.
Cedar Shopping Center, 184 South Livingston Avenue
2 spaces located near the front entrance and 1 space located near the rear entrance of the Cedar Shopping Center, as shown on the site plan on file in the office of the Township Clerk which is made a part of this section. Each space is eight feet in width with a five-foot aisle adjacent and 20 feet in length.
Don's Restaurant and Pastry Shop
2 spaces located in off-street parking facilities near northeast corner of building, as shown on the attached site plan (not included herein), which is made part of this section. Each space shall be a minimum of 20 feet in length.
60 East Mount Pleasant Avenue
1 space located along the southerly side, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet wide and a minimum of 20 feet in length.
72 East Mount Pleasant Avenue
1 space located near the ramp leading to the entrance of the Ritz Diner, 72 East Mount Pleasant Avenue, as shown on the attached site plan (not included herein), which is made a part of this section. The space is 8 feet in width, with a five-foot aisle next to it. It is a minimum of 20 feet in length.

2 spaces at the entrance to number 105 East Mt. 19 spaces located near three entrances to the corporate center, as shown on the site plan on file in the office of the Township Clerk which is made a part of this section. Each space shall be a minimum of 12 feet in width and a minimum of 20 feet in length.

16 spaces located at various sites on the property at 277 Eisenhower Parkway, also known as The Village of Livingston, as shown on the attached site plan (not included herein), which is made a part of this section. Each space is a minimum of 8 feet in width and has an adjacent aisle 5 feet in width. Each space shall be a minimum of 20 feet in length.
293 Eisenhower Parkway
8 spaces located on the southerly side of the office building, as shown on the attached site plan (not included herein), which is made part of this section. Each space shall be a minimum of 12 feet in width.
354 Eisenhower Parkway

Any person parking a motor vehicle in a handicapped parking space without a special vehicle identification card or a temporary handicapped placard shall be liable for a fine of $250 for the first offense and a fine of $250 and a maximum of 90 days' community service on such terms and in such form as a court shall deem appropriate for subsequent offenses.
Any property owner required to install and maintain a sign designating handicapped parking shall be issued a notice if such sign does not conform to the current Uniform Traffic Control Devices Manual. If such property owner fails to install or maintain a conforming sign within 30 days of receipt of such notice, the Township Manager shall undertake to install or maintain a conforming sign. The property owner will be responsible for reimbursing the Township for any costs incurred in the installation or maintenance of a conforming sign.
A person who owns or controls a parking area is responsible for assuring that parking spaces reserved for handicapped motorists and curb cuts and other improvements designed to provide accessibility are not obstructed. If the obstruction is ice or snow, it must be removed from the parking space, curb cut or other improvement within 48 hours after inclement weather has ended. A violation of this provision shall be liable for a fine of not less than $200 or more than $500.

In any space on private property appropriately marked for vehicles for the physically handicapped pursuant to § 29-26 of this subarticle, municipal law enforcement officers or parking enforcement authority officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped by issuing fines as outlined in this subarticle, § 29-27.1.
Subarticle B. Parking in Front of Public Buildings and on Township Land

The purpose of this subarticle is to prohibit parking in areas designated for use as handicapped parking, except by persons who have been issued special identification cards by the Director of the Division of Motor Vehicles or a temporary handicapped placard issued by the Chief of Police, in front of public buildings and upon land owned or leased and maintained by the Township, a municipal parking authority or the Board of Education.
This subarticle is enacted in accordance with N.J.S.A. 39:4-197 and 39:4-197.5, which do confer upon the Township of Livingston the right to establish handicapped parking spaces in order to preserve and safeguard the public health, safety, morals and welfare.

2 spaces on the southwesterly end of the school, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Heritage Middle School
2 spaces on the easterly side of the school, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Hillside Elementary School
1 space at the northwesterly corner of the school, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Library
3 spaces located along the northern entrance (designated as the special service entrance) to the library, as shown on attached on the site plan (not included herein). Each space shall be a minimum of 12 feet in width.
Livingston High School
2 spaces on the southwesterly side of the school, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Livingston Public Library
2 spaces located along the northerly entrance, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet wide and a minimum of 22 feet in length.
Memorial Park Swimming Pool

4 spaces in the southeast corner of the parking lot of the swimming pool, as shown on the attached site plan (not included herein) which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Monmouth Court Community Center
2 spaces in the northeast corner of the parking lot in front of the entrance, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet wide and a minimum of 22 feet in length.
Monmouth Court Recreation Center
2 spaces on the lower level in front of the (gym) handicapped entrance to Recreation Center, as shown on the attached site plan (not included herein). Each space shall be a minimum of 12 feet in width.
Mount Pleasant Middle School
1 space on the westerly side of the Middle School to serve the elementary school and 2 spaces on the westerly side of the Middle School to serve the middle school, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Northland Recreation Center
3 spaces located in front of the entrance to the center, as shown on the attached site plan (not included herein). Each space shall be a minimum of 12 feet in width.
Plaza Place
2 spaces on the northeasterly side, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
Police Department
1 parking space located near the main entrance ramp to the Police Department, as shown on the attached site plan (not included herein). Each space shall be a minimum of 12 feet in width.

1 space on the southwesterly side of the school, as shown on the attached site plan (not included herein), which is made a part of this section. Each space shall be a minimum of 12 feet in width.
