As used in this chapter, the following terms shall have the meanings
indicated:
Any public place where the game known as "billiards" or "pool" in
whatever form the game is permitted to be played, including but not by way
of limitation, carom billiards, pocket billiards, pool, three cushion billiards,
and English billiards.
Except as provided in § 77-6, no person shall conduct or operate a billiard or pool room in the Township without first having obtained a license therefor as hereinafter provided.
The application for a license under this chapter shall be made in writing
to the Township Clerk.
A.
The application shall state:
(1)
The location of the premises for which the license is
desired.
(2)
The name of the owner of the premises.
(3)
If the license is to be issued to a person other than
the owner of the premises, then the name and address of such person.
(4)
The name and address of the manager or person who shall
be in charge of the licensed premises.
(5)
Whether the applicant has ever been convicted of a crime
or disorderly persons offense or violation of an ordinance involving gambling
and if so, the nature of the offense, and date and place of the conviction.
No license shall be issued by the Township Clerk until after investigation
and recommendation by the Chief of Police and approval by the Council.
The license requirement to conduct or operate a billiard or pool room
shall not apply to private residences, schools, municipal institutions or
charitable organizations.
A.
The following acts are prohibited:
(1)
The licensed premises shall be closed for business on
Sundays between the hours of 2:00 a.m. and 1:00 p.m.
(2)
No minor, who is under the age of 16 years and is unaccompanied
by a parent or guardian shall play or partake in any game on the licensed
premises or frequent, lounge or remain on the licensed premises.
(3)
No minor, over the age of 16 years and under the age
of 18 years, shall play or partake in any game on the licensed premises after
the hour of 7:00 p.m. or frequent, lounge or remain on the licensed premises
after 7:00 p.m.
(4)
There shall be no gambling of any form in or at the licensed
premises.
(5)
No person under the age of 18 years shall be employed
in any capacity in or at the licensed premises.
(6)
No intoxicated or disorderly person shall be admitted
to the licensed premises or permitted to remain therein.
A.
Any license issued under this chapter may be suspended
by the Township Manager for any violation of this chapter or whenever in his
judgment it may be necessary for the welfare of the Township.
B.
The Council may revoke any license issued under this
chapter upon good cause and after notice and hearing, if one is requested
by the licensee.
Any person who violates any provision of this chapter shall, upon conviction
thereof, be punished by a fine not exceeding $500, or by imprisonment for
a term not exceeding 90 days, or both, A separate offense shall be deemed
committed on each day during or on which a violation occurs or continues.
