As used in this article, the following terms shall have the meanings indicated:
FOOD AND BEVERAGE VENDING MACHINE OR MACHINE
Any device offered for public use which, upon insertion of a coin, coins or token, or by other means, dispenses unit servings of food or beverage, either in bulk or in package, without the necessity of replenishing the device between each vending operation.
No person shall maintain or permit to be maintained any food and beverage vending machine unless a license to sell or dispense food or beverage from the machine has been obtained from the Division of Health.
A. 
A fee of $25 per license for each food and beverage vending machine, approved by the Division of Health, is hereby established.
B. 
Each permit shall expire on the 31st of December of each year.
The sale of dispensing of food or beverages from a machine shall be permitted only in a store, factory, theater, school, office, club, lodge, community center, recreational building, charitable institution, personal service establishment or building of public assembly.
No person shall place, erect, operate or maintain any machine for the sale of food or beverage in any location except as permitted in § 146-11.
A. 
The dispensing device and containers shall be of a type acceptable to the Division of Health.
B. 
All parts of the dispensing container with which milk or fluid milk products or any liquid food or drink come into contact shall be thoroughly rinsed before returning to the shipper and shall be cleaned and sanitized at the plant.
C. 
The dispensing device or container shall be filled at the plant furnishing the milk, milk product or other liquid food or drink and shall be sealed with two seals in such a manner as to make it impossible to withdraw any part of its contents without breaking one seal, and impossible to introduce any substance without breaking the other seal. The latter seal shall remain intact until the device or container is emptied and removed from the dispensing unit. The use of an embossed seal identifying the plant is desirable, so that the refilling and resealing of the device or container by any person outside the plant can readily be detected.
D. 
Only homogenized milk shall be dispensed except where the dispensing device is used for a fluid product in which case the dispensing device shall thoroughly and automatically mix the fluid milk product with each dispensing operation except in those cases where the fluid milk product remains homogenous without mixing.
E. 
The cabinets containing dispensing devices or containers shall be properly labeled as to the product being dispensed therefrom.

The vending machine shall be of a type acceptable to the Division of Health.
B. 
The interior shall be designed and constructed as to be readily cleaned and kept clean.
C. 
Milk and milk product machines shall have a refrigeration unit of sufficient capacity so as to keep the entire content of milk or milk product at a temperature of 50° F. or below.
D. 
The vending machine for milk or a milk product shall be equipped with an automatic cut-off device that locks the machine when the temperature of the interior where milk or milk product is stored goes above 50° F., and also refuses patrons' coins.
E. 
Only milk approved by the Division or milk products in approved containers shall be dispensed from vending machines which shall be serviced regularly and kept clean.
F. 
Vending machines shall be properly labeled as to the product being dispensed therefrom.
Unless another penalty is expressly provided herein, any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine of not less than $50 nor more than $1,000, or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
