The Township does hereby adopt the state code of regulation of milk and milk products as provided in N.J.S.A. 24:10-57.10.
A. 
Milk licenses.
(1) 
No person, either as principal or through agents or employees, shall sell any milk or cream in the Township without a license obtained from the Division of Health; provided, however, that no license shall be required for the sale of milk or cream by a person licensed to operate a retail food establishment under § 146-2.
(2) 
A license fee of $5 per year, or fraction thereof, is hereby established for each establishment and vehicle used in the sale of milk or cream.
(3) 
Such license shall not be transferable and shall continue in force and effect until the first day of January next ensuing the date of issuance thereof unless previously suspended or revoked.
B. 
Permit for change of supply. No person, having been granted a license hereunder, shall procure for sale in the Township any milk or cream from a source other than the source specified on the application for a license, without first having obtained a permit to do so from the Division of Health.
C. 
Applications. Each application for a license or permit required under the terms of this section shall be made in writing, signed by the applicant, upon forms supplied by the Division of Health for that purpose and shall truthfully set forth all information which may be necessary to ascertain the facts that the milk or cream proposed to be sold by the applicant is of the standard and quality required by and was produced, handled, processed and transported in accord with the provisions of state law and regulations and such other information as may be necessary to the proper administration of this chapter.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine of not more than $100.
