[HISTORY: Adopted by the Township Council of the Township of Livingston 11-5-1979 as Ch. 21 of the 1979 Revised General Ordinances. Amendments noted where applicable.]
This chapter shall be known and may be cited as the "Plumbing Code of the Township of Livingston."
A. 
The Council hereby determines that the state has preempted certain areas of plumbing regulation through the enactment of N.J.S.A. 52:27D-119 et seq. and N.J.A.C. 5:23-1 et seq. and the adoption of the Plumbing Subcode for New Jersey by the State Department of Community Affairs.
B. 
The Council further determines that other areas of plumbing regulation require municipal control.
A. 
No person shall engage in the practice of plumbing unless such person holds a valid state master plumber's license or a valid master plumber's license issued by the Township.
B. 
No person who is not a holder of such a license shall engage in or carry on or represent himself as engaging in or carrying on the practice of plumbing as a master plumber, nor shall any person not the holder of such license use the words "master plumber," "plumber" or "plumbing" or any other term in any advertisement or display a sign to indicate, imply or designate him as engaging in the practice of plumbing.
A. 
The Manager shall appoint a Board of Plumber Examiners which shall consist of the Plumbing Subcode Official and two master plumbers.
B. 
Each of the master plumbers shall be appointed for terms of four years or until his successor is appointed and qualified.
C. 
A vacancy occurring in the master plumber membership of the Board shall be filled by the Manager for the unexpired term.
The Board of Plumber Examiners shall hold examinations designed to test the knowledge and ability of applicants for a license as a master plumber relative to installation of proper plumbing. They shall make recommendations to the Township Plumbing Inspector relative to the issuance or denial of a license to those who have taken the examination.
A. 
The Township Plumbing Inspector shall issue a master plumber's license to each applicant who has successfully passed the examination given by the Board of Plumber Examiners.
B. 
Such licenses shall be nontransferable.
Master plumber's licenses shall expire on the last day of December of each year and may be renewed at any time within six months of their expiration date without reexamination of the licensee. Licenses not renewed within six months of the expiration date may not be renewed until the applicant has been reexamined.
The following fees and charges are established:
A. 
For the examination of any applicant for a license as a master plumber: $25.
B. 
For the issuance of a license as a master plumber: $100.
C. 
For the issuance of the annual renewal of a master plumber license: $10.
D. 
For the filing of a plan for proposed plumbing work: $2.
E. 
For the issuance of a permit for a proposed plumbing construction or alteration: $2.
F. 
For each fixture proposed in the approved plan for construction or alteration, additionally: $2.
G. 
For the issuance of a permit for the replacement of a plumbing fixture: $2.
H. 
For each reinspection of plumbing work caused by the failure of the licensee to comply with the provisions of the State Plumbing Subcode or the provisions of the issued permit: $5.
Nothing contained in this chapter or in the State Plumbing Subcode shall be deemed or construed to apply to or govern the doing or performance of any work beginning five feet outside the inner face of a building wall, but the same shall be governed by the applicable provisions of the Chapter 269, Standard Specifications.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500, or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
