No person shall install any septic tank and no constructor shall install any other container for the reception or storage of sewage in the Township without first obtaining a license as hereinafter provided.
A.
The Board of Examiners, as heretofore created, is hereby continued.
B.
The Board of Examiners, consisting of the Township Engineer, Health Officer and Plumbing Subcode Official, shall conduct examinations for the purpose of determining the qualifications and ability of applicants for licenses to engage in the business of installing septic tanks or the construction of other containers used for the reception or storage of sewage, within the Township.
A.
The Board of Examiners shall conduct examinations which shall test the applicant's knowledge of and familiarity with the Standards for the Construction of Sewerage Facilities for Realty Improvements, promulgated by the New Jersey State Commissioner of Health on December 7, 1954, pursuant to N.J.S.A. 58:11-23 et seq., known as the "Realty Improvement Sewerage and Facilities Act (1954)," and such other standards as may, from time to time, be promulgated by the State Commissioner of Environmental Protection pursuant to said Act, or any amendment thereof or supplement thereto.
B.
The Board of Examiners shall conduct such examinations at least twice a year and at intervals not exceeding six months, provided an application is on file.
A.
No person shall be admitted to an examination for a license unless it appears from his application that he is at least 18 years of age, is a citizen of the United States, and has had at least two years' experience in the business of installing septic tanks or constructing other containers for the reception or storage of sewage.
B.
Upon filing his application, each applicant shall pay an application fee of $10.
The Board of Examiners shall make its recommendations in writing to the Division of Health relative to the issuance or denial of a license to an applicant who shall have taken such examination.
A.
The Division of Health shall issue a license to each applicant who has successfully passed the examination given by the Board of Examiners, authorizing such licensee to engage in and conduct such business within the Township provided a bond is filed with the Division of Health pursuant to the requirement of § 249-8.
B.
Every such license shall expire on the last day of December in each year and may be renewed at any time within two years of its expiration date without reexamination of the licensee. A license not renewed within two years of its expiration date shall not be renewed until the person to whom it was issued shall have been reexamined in accordance with the provisions of this chapter.
The fee for the issuance of a license, or any renewal thereof, shall be $15.
Every licensee shall file with the Division of Health a bond in the amount of $500 executed by a surety company authorized to transact business in the State of New Jersey, conditioned upon the compliance by the licensee with the provisions of the aforesaid standards promulgated by the New Jersey State Commissioner of Environmental Protection and with the provisions of this chapter.
A.
Any license issued pursuant to the provisions of this chapter may be suspended or revoked by the Health Officer in the event that:
(1)
The license was obtained by fraud or misrepresentation; or
(2)
The licensee is shown to be incompetent in installing septic tanks or constructing other containers for the reception or storage of sewage, having regard for the public health and safety; or
(3)
The licensee who shall install or construct a septic tank or other container for the reception or storage of sewage shall permit or suffer the work to be done by a person or persons other than the holder of a license or his employees; or
(4)
The licensee has created conditions dangerous to life or health.
B.
The license may be revoked, after notice and hearings for any of the above causes.
C.
Pending such hearing, if conditions so warrant, the Health Officer may suspend the license for a period of not more than 10 days.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500, or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
