As used in this article, the following terms shall have the meanings
indicated:
Garbage, refuse and other discarded materials resulting from industrial,
commercial and agricultural operations and from domestic and community activities
and shall include all other waste materials including liquids disposed of
incident thereto, except it shall not include solid animal and vegetable wastes
collected by swine producers licensed by the State Department of Agriculture
to collect, prepare and feed such wastes to swine on their own farms.
The activity related to pickup and transportation of solid waste
from its source or location to a disposal site.
Any person engaged in the activity of solid waste collection.
Every solid waste collector shall provide satisfactory evidence of an
approved place for the disposal of solid wastes outside the territorial limits
of the Township.
A.Â
The collector shall collect and transport all solid wastes
received by him in tightly covered motor-driven trucks equipped with metal
bodies to prevent any such matter from spilling therefrom.
B.Â
The collector shall have and make available a sufficient
number of trucks or vehicles of ample power and capacity properly and adequately
to carry on his business and shall at all times have available for use at
least one spare vehicle in the case of a breakdown.
C.Â
All vehicles used by the collector shall at all times
be subject to inspection and approval by the Health Officer or Sanitarian,
and shall be kept and maintained in a clean and sanitary condition and in
good working order.
All solid wastes collected or received by a collector which shall spill
or fall while being carried or conveyed to a truck or other collection vehicle
or container, or while being loaded in, or transported by, any such truck,
vehicle or other container, shall be immediately removed and broom-cleaned
so as to leave the premises or street in a clean condition.[1]

No collector shall commence collection of solid wastes
before 6:00 a.m. nor after 6:00 p.m.
B.Â
All solid wastes shall be collected promptly and shall
be forthwith transported by the collector outside the territorial limits of
the Township in the same trucks or vehicles in which the same was collected.
C.Â
It shall be unlawful to transfer the contents, or any
part thereof, of any such truck or vehicle to any other truck or vehicle within
the territorial limits of the Township.
D.Â
Every collector hired to furnish solid waste collection
service shall make at least two collections in each week.
E.Â
All collections shall be made at ground level from the
rear of the building and, if more than one building, from the rear of the
main building on the premises from proper and suitable receptacles or containers
provided by the occupants of the premises or building, as required by other
ordinances of the Township.
F.Â
All materials so collected shall be carried from the
premises and deposited directly into a truck or vehicle which will be made
available to receive the same. No collector, or employee of a collector, shall
place, or cause or permit to be placed, any receptacle containing solid wastes
along a curb or within the roadway of any street pending the arrival of a
truck or vehicle to carry the same away nor after such receptacle shall have
been emptied.

No solid waste material shall be placed or caused or
permitted to be placed for collection along the curb or within the roadway
of any street earlier than 12:00 noon on the day immediately before the scheduled
pickup or collection. This time restriction shall not apply to the periodic
spring cleanup conducted in the Township.
A.Â
Every collector shall maintain an office with a telephone
connection, and shall keep such office open daily, except Sundays and holidays,
from 8:30 am. to 4:30 p.m., and on Saturdays from 9:00 a.m. to 12:00 noon,
with a competent person in charge thereof to receive complaints and notices
or directions from officials of the Township.

All such complaints shall be immediately investigated
and corrected and all notices and directions from proper officials of the
Township shall be immediately complied with.
A.Â
Every collector shall deliver to all persons to whom
he shall furnish collection service a printed card or other notice setting
forth his name, address, telephone number, and the days on which collections
will be made, the rules and regulations governing such collections and the
rates to be charged therefor.
B.Â
A collector who shall neglect or refuse to make a collection
on any day when required to do so shall be guilty of a violation of this article.
A collector shall be entitled to charge, receive and collect from a
person to whom he shall furnish collection service such rates as shall from
time to time be approved by the Council by resolution.
All collectors shall comply with state laws, state regulations, ordinances
of the Township and the rules, regulations and orders of the Division of Health.
Unless another penalty is expressly provided herein, any person who
violates any provision of this chapter shall, upon conviction thereof, be
punished by a fine of not less than $50 nor more than $1,000, or by imprisonment
for a term not exceeding 90 days, or both. A separate offense shall be deemed
committed on each day during or on which a violation occurs or continues.
