As used in this article, the following terms shall have the meanings indicated:
LICENSEE
The person to whom a license to operate a teenage dance hall is issued and shall include the manager in charge or control of the licensed premises and, where the context requires, any agent or employee of the licensee.
TEENAGE DANCE HALL or LICENSED PREMISES
A place of public assemblage for persons between 14 and 20 years of age where dancing is provided at a fixed admission charge and nonalcoholic beverages are served, and is conducted as a place of business for profit.
No person shall conduct or engage in the business of operating a teenage dance hall in any premises within the Township without first having obtained a license therefor, as provided in this article, and upon payment of an annual license fee of $200.
A. 
The license shall expire on the 31st day of December in each year.
B. 
Only one license shall be issued and outstanding in the Township.
C. 
No transfer of a license shall be permitted.
A. 
Any person desiring to obtain a license to conduct or engage in the business of operating a teenage dance hall shall make application for the same, in triplicate, to the Township Clerk.
B. 
Said application shall state:
(1) 
Name, home address and business address, if any, of the applicant and if the applicant is a corporation or other legal entity, the names and home addresses of all principals of the entity.
(2) 
Name, home address and business address, if any, of the owner of the premises if such owner is a person other than the applicant.
(3) 
Name and home address of the manager, if any, who shall be in charge of the licensed premises.
(4) 
Proposed capacity, stated in number of persons, of the premises for which the license is sought.
(5) 
Hours of intended operation for said teenage dance hall.
C. 
The application shall be accompanied by a plat or drawing of the premises in triplicate, drawn to scale, showing its location, size and capacity; the location and size of entrances and exits; the location and number of toilet facilities; and such other data or information as may be necessary or required to show compliance with all the requirements of this article.
The Township Clerk shall promptly forward the application and accompanying material to the Township Manager who shall refer the same to the following officials for investigation and report:
A. 
Chief of police.
B. 
Fire Chief.
C. 
Construction Official.
D. 
Health Officer.
If, after investigation and reports by the officials referred to in the previous section, the Council is satisfied that the individuals and manager, if any, named in the application are persons of good moral character and capable of operating the proposed teenage dance hall in a manner consistent with the public safety and good morals, and that all of this article's requirements have been met and further that the pertinent provisions of the Building Code, Fire Prevention Code and Plumbing Code[1] that govern the Township have been fully complied with, the Council shall authorize the Township Clerk to issue the license.

A. 
Hours of operation. The licensee shall not permit, suffer or allow the licensed premises to be open for business at any time except between the hours of 8:00 p.m. and 11:30 p.m., or at any time on any day preceding a day when the public schools system of the Township shall be in regular session.
B. 
Persons excluded. The licensee shall not permit, suffer or allow any person who is less than 14 years of age or more than 20 years of age, or any intoxicated or disorderly person, to be admitted to the licensed premises or to remain therein.
C. 
Readmittance. The licensee shall not permit, suffer or allow any person who, after paying his admission charge, has been admitted to the licensed premises and has left the same to be readmitted at any time during the same night.
D. 
Good order. The licensee shall maintain good order upon the licensed premises and shall not permit loitering in or about the entrances, exits, sidewalks or motor vehicle parking lots.
E. 
Gambling prohibited. The licensee shall not permit, suffer or allow any gambling in any form at or in the licensed premises.
F. 
Intoxicating liquors. No person in the licensed premises shall have in his possession or under his control, or offer to give to another to drink, any intoxicating liquor, nor shall a licensee hereunder permit, suffer or allow such conduct.
G. 
Employees and attendants.
(1) 
At all times during business hours, the licensee shall provide an adequate number of qualified security officers continuously on duty who shall patrol the licensed premises and its entrances, exits and motor vehicle parking areas to see that:
(a) 
Order is maintained;
(b) 
Disorderly or immoral conduct is prevented;
(c) 
Entrances, exits and motor vehicle parking areas are kept free from congestion and loitering; and
(d) 
Provisions of this article are observed and complied with.
(2) 
All such attendants and all other persons employed in any capacity in or at the licensed premises, exclusive of musicians, shall be at least 18 years of age.
H. 
Commercial activities. Any sale of beverages, confections or other articles of merchandise shall be governed by the laws and ordinances governing such business and shall require the same license or licenses as if such sales were conducted elsewhere.
I. 
Noise. No loudspeaker or public address system, nor any other manual, mechanical or electrical means or device for amplifying sound, shall at any time be used, or permitted to be used, upon the licensed premises so as to be heard out of doors. Any loud, unnecessary, annoying, offensive, undesirable or raucous noise which disturbs the public peace emitted by, or emanating from, the licensed premises is hereby declared to be a nuisance and detrimental to the public health, and is hereby prohibited.
The provisions of this article shall not apply to any person conducting or engaging in the business of providing dancing, entertainment or amusement where admission charges are to be used exclusively for charitable, eleemosynary, educational or religious purposes.
When the operation of any teenage dance hall, or the conduct of any licensee, agent or employee, is so inimical to the public health, safety or general welfare as to give rise to an emergency or to constitute a nuisance, the Manager shall have the authority summarily to order the cessation of business and the closing of the licensed premises or to suspend the license; or the Council, after hearing, upon a showing of good cause for its so doing, may revoke any license issued hereunder. During such suspension, or after any such license shall have been revoked, the license shall be inoperative and of no effect.
Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

As used in this article, the following terms shall have the meanings indicated:
PARADISE DANCE
A dance held from time to time as a teen center program for teen center participants and shall include any other term used to describe a dance for teen center participants.
TEEN CENTER
That portion of the Monmouth Court Community Center utilized for the teen center program.
TEEN CENTER PARTICIPANT
Any person between the ages of 13 and 19 who participates in a teen center program.
TEEN CENTER PROGRAM
Any program planned and supervised by the Director of Youth Services and operated by the Township of Livingston in the teen center.
Teen center participants shall pay the following fees:
A. 
Admission to the teen center for teen center programs other than a paradise dance: $3.
B. 
Admission to teen center for a paradise dance: $5.
